applicable period and diligently pursued until such failure is corrected; and further provided that <br />if by reason of Force Majeure the Board of Education is unable in whole or in part to carryout any <br />of its agreements contained herein (other than its obligations contained in Sections 6.2 or 7.1), <br />the Board of Education shall not be deemed in default during the continuance of such event or <br />occurrence. <br />11.2 Remedies on Default. Whenever any Event of Default shall have happened and be <br />continuing, the County may take one or any combination of the following remedial steps: <br />(a) Collect damages; <br />(b) Have reasonable access to and inspect, examine and make copies of the Board of <br />Education's books, records and accounts during the Board of Education's regular business hours, <br />if reasonably necessary in the County's opinion. <br />ARTICLE XII <br />MISCELLANEOUS <br />12.1 Notices. All notices, certificates or other communications hereunder shall be sufficiently <br />given and shall be deemed given when delivered or mailed by registered mail, postage prepaid, addressed <br />as follows: <br />(a) If intended for the County, addressed to it at the following address: <br />Cabarrus County Governmental Center <br />P.O. Box 707 <br />Concord, NC 28026-0707 <br />Attention: County Manager <br />(b) If intended for the Board of Education, addressed to it at the following address: <br />Kannapolis City Schools Board of Education <br />100 Denver Street <br />Kannapolis, NC 28083 <br />Attention: Superintendent <br />12.2 Binding Effect. This Lease shall be binding upon and inure to the benefit of the Board of <br />Education and the County, subject, however, to the limitations contained in Article XI. The terms and <br />provisions of this Lease supersede entirely the terms and provisions of any other existing lease(s) between <br />the County and the Board of Education regarding the Site. <br />12.3 Amendments, Changes and Modifications. This Lease may only be amended, changed, <br />modified or altered by a writing signed by both parties. <br />12.4 Net Lease.
