87 The Board of Commissioners for the County of Cabarrus met in recessed session at the County Courthouse in Concord, North Carolina on Wednesday, April 19, 1989, at 5:00 P.M. Present - Chairman: James W. Lentz Commissioners: R. Giles Moss William G. Hamby, Jr. Martha H. Melvin Billy J. Simmons, Jr. Also present were the following members of the Concord Board of Aldermen: Mayor Bernie Edwards, Mayor Pro-Tem James L. Dorton and Aldermen T. Laine Harling, Robert L. Mathis, Jr., Lamar Barrier, Wilson F. Cone, Jr., and Dr. Hector H. Henry. The invocation was given by Alderman Cone. Chairman Lentz and Mayor Edwards called to order the joint meeting of the Board of Commissioners and the Board of Aldermen. They announced that the two boards had reached an agreement relative to the Coddle Creek Reservoir Project and were meeting at this time to finalize the matter. Motion was made by Alderman Henry and seconded by Alderman Mathis to approve the "Agreement to Supply Treated Water" between the City of Concord and Cabarrus County. The motion was approved unanimously. Motion was made by Mayor Pro-Tem Dorton and seconded by Alderman Barrier to approve the "Agreement Relative to the Construction, Operation and Maintenance of a Water Supply Reservoir" between the City of Concord and Cabarrus County. The motion was unanimously carried. UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and unanimously carried, the Board approved the following Agreement between the City of Concord and Cabarrus County. NORTH CAROLINA CABARRUS COUNTY AGREEMENT RELATIVE TO THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A WATER SUPPLY RESERVOIR THIS AGREEMENT of Interlocal Cooperation, pursuant to Article 20 of Chapter 160A of the General Statutes of North Carolina, made and entered into this 19 day of April, 1989, by and between the CITY OF CONCORD, North Carolina (hereinafter referred to as "CONCORD"), and CABARRUS COUNTY (hereinafter referred to as "CABARRUS"); ~ W I T N E S S E T H: that WHEREAS, CONCORD and CABARRUS agree that it is mutually beneficial for CABARRUS to construct, operate and maintain a dam, lake and watershed in Cabarrus County, North Carolina, on Coddle Creek of approximately 1,900 acres, more or less (hereinafter referred to as the "Reservoir"), in order to provide and supply an additional source of raw water for the residents of the greater Cabarrus County area; and WHEREAS, CONCORD: (a) currently owns and operates a 10 million gallon per day (MGD) capacity raw water pumping station along Coddle Creek (the "Existing Pump Station") in or about the site of the Reservoir from which it currently draws raw water for use in its municipal water system through an existing 24- inch raw water transmission line (the "Existing Raw Water Line") leading to its Hillgrove Water Filter Plant ("Hillgrove"); (b) currently owns approximately 513.8173 acres of land in or about the Reservoir, more particularly described in "Exhibit A" attached hereto and incorporated herein by reference (the "Concord Real Property"); (c) has previously employed Peirson and Whitman, Inc., to prepare plans and specifications and surveys and to perform other engineering activities for the development of the Reservoir, or otherwise, and also has secured appraisals for the real property involved, all of which are more particularly identified in "Exhibit B" attached hereto and incorporated herein by reference (the "Concord Plans and Documents"); and (d) has previously forwarded Notice of Intent to File Condemnation Action under G.S. 40A-40 to other landowners in the vicinity of the Reservoir whose property has not yet been acquired by CONCORD or CABARRUS, a listing of such landowners being attached hereto marked "Exhibit C" and incorporated herein by reference; and
