396 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in special <br />session in the Commissioners' Meeting Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Thursday, October 2, 1997, at 5:30 P.M. to <br />consider the following: (1) Sale of County-owned property located on Union <br />Street; (2) Discussion of implementation of the "Ordinance Creating Procedure for <br />Initiative, Referendum and Direct Voting on Questions of Public Interest," <br />including a possible closed session as authorized by N.C. General Statute 143- <br />318.11(a)(3); and (3) Closed session to consult with County Attorney regarding <br />pending or threatened litigation relating to Lake Concord Ventures as authorized <br />by N.C. General Statute 143-318.11(a)(3). <br /> <br />Present - Chairman: Sue B. Casper <br /> Vice-Chairman: Carolyn B. Carpenter <br /> Commissioners: Jeffrey L. Barnhart <br /> Kenneth Mills <br /> Franklin C. Niblock, Jr. <br /> <br /> Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. Fletcher <br />L. Hartsell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Casper called the meeting to order at 5:30 P.M. <br /> <br />Approval of Agenda <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Niblock and <br />unanimously carried, the Board approved the agenda with the addition of <br />authorization of a contract for consultants to study the school merger issue. <br /> <br />Consideration of the Sale of County-Owned Property Located on Union Street in <br />Concord <br /> <br /> Mr. Clifton advised that the following two proposals had been received for <br />the sale of the County-owned buildings at 70-82 South Union Street in Concord: <br />(A) Preservation Associates, LLC of Columbia, S.C. - $85,000.00 cash purchase; <br />and (B) John H. McCrimmon, Jr. of Concord - $75,000.00 cash purchase. The sale <br />will be through the Historic Preservation Foundation of North Carolina which will <br />receive $3,500.00 for its role in the process. Mr. Clifton recommended <br />acceptance of the higher offer. <br /> <br /> Mr. Gary Firmender of Preservation Associates briefly outlined plans for <br />the property, including a restaurant and retail and office space. <br /> <br /> Mr. John McCrimmon of Old Concord Development briefly discussed his plans <br />for the property, including a fitness center, office space and a restaurant. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Chairman Casper and <br />unanimously carried, the Board accepted the higher offer of $85,000.00 for the <br />sale of the buildings on Union Street and authorized the County Manager and <br />County Attorney to proceed with the requirements to complete the transaction. <br /> <br />Contract for Consultant for School Study <br /> <br /> Mr. Clifton reported that it was the consensus of the two school boards to <br />select The Masonboro Group as the consultant for a study of the two school <br />systems. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Niblock and <br />unanimously carried, the Board approved the selection of The Masonboro Group, <br />Inc. as the consultants for a study of the two school systems regarding merger <br />options at a cost of $51,975.00 and authorized the County Manager and County <br />Attorney to draw up the appropriate contract. <br /> <br />Closed Session - Consultation with Attorney <br /> <br /> UPON MOTION of Commissioner Mills, seconded by Commissioner Carpenter and <br />unanimously carried, the Board moved to go into a closed session to consult with <br />the County Attorney regarding legal matters associated with the implementation <br />of the "Ordinance Creating Procedure for Initiative, Referendum and Direct Voting <br />on Questions of Public Interest" (adopted September 15, 1997 and effective <br />October 1, 1997) and regarding pending or threatened litigation relating to Lake <br />Concord Ventures as authorized by N. C. General Statute 143-318.11(a)(3). <br /> <br /> <br />
