The Cabarrus County Commissioners met at their regular monthly meeting on October 3 <br /> <br /> 1960 at 10:OO A M at the Courthouse with the following members present: <br /> Chairman: W. Frank McCray <br /> <br /> Commissioners: M. Smoot Lyles, L BowmanBarrier, W.Guy Isenhour and P.Ernest Stallings <br /> <br /> Motion by L.Bowman Barrier, seconded by P.Ernest Stallings that the Rimer V.F.D. be given <br /> $100.00 per month. <br /> <br />Motion by W. Guy Isenhour, seconded by M. Smoot Lyles that the Chbarrus Rescue Squad be given <br /> <br /> $1000.O0 for equipment. <br /> <br /> Motion by W.Guy Isenhour seconded by L.Bowman Barrier that the following be named to Board <br /> <br /> of Rockland Sanitary Annex: R.F. Staton, Rev. Johnny MOrton and Leonard Aycock: <br /> <br /> Commissioner W.Guy Isenhour introduced the following resolution which was read: <br /> <br /> RESOLUTION OONCERNING A RESOLUTION OF THE NORTH CAROLINA STATE B~RD OF <br /> HEA~ CREATING THE ROCKLAND SANITARY DISTRICT IN CABARRUS CDUNTY, NORTH <br /> CAROLINA, AND APPOINTING A SANITARY DISTRICT BOARD FOR SAID DISTRICT. <br /> <br /> BE 'IT RESOLVED by the Board of Commissioners for the County of Cabarrus: <br /> <br />Section 1. That the Board of Commissioners has determined and does hereby find and de~lare: <br />(a) That there has been r eceived from the North Carolina State Board of Health a resolution <br />passed on September 6, 1960, creatin§ the Rockland Sanitary District in Cabarrus County, North <br />Carolina, ~htch resolution is as follows: <br /> <br /> "BE IT RESOLVED: That the North Carolina State Board. of Health, upon giving due consideratiol <br />to the proposal to create the Rockland Sanitary District, Cabarrus County, North Carolina, finds <br />the following facts in relation thereto, to wit: <br /> (A) That the petition, containing the names of over fifty-one per cent (51%) of the <br />resident freeholders for the creation of said sanitary district as prescribed by law, was filed <br />with the Board of Commissioners of Cabarrus County, N~rth Carolina, and duly approved by sa~d <br />Board. <br /> (B) The State Board of Health was duly notified through the Chairman of the Board of <br />Commissioners of CabarrusCounty~ therefor, the State Hearth Director of the State of North <br />Carolina and the Chairman of the Board of Commissioners of Cabarrus County mutually set thedate <br />and place 6or the hearing to be held on July 29,1960, at ;4 P M in the Bright Light Baptist <br />Church located within the territory of the proposed sanitary district. <br /> <br /> (C) Notice of the 3oint public hearing was duly given by posting a notice on the bulletin <br />board at the Cabarrus County Courthouse and publishing for four (h) successive weeks in the <br />"Concord Tribune", a newspaper published in Concord and having §eneral circulation within the <br />~errttory to be included in the proposed sanitary district. <br /> <br />( (D) That a 3oint public hearing ~as held by the Board of Commissioners of Cabarrus County <br />and representatives of the North Carolina State Board of Health, to wit: <br />Mr.W.S. McKimmon, Chief of the Engineering Section, and Mr. Marshall Staton, Distr~ct Engineer, <br />Sanitary Engineering DivisiOn, upon the question of creating the Rockland Sanitary District, <br />Cabarrus County~ the 3oint public hearing having been held in accordance with the publication of <br />said notice on Friday, the 29th day of July, 1960, at h P M in the Bright Light Baptist Church <br />located within the territory of the proposed sanitary district. <br /> <br /> (E) That at the said 3oint public hearing no opposition to the creation of the sanitary <br />district was encountered. Therefore, the Board of Commissioners of Caha~rus County a nd the <br />representatives of the State Board of Hearth agreed that the creation of the Rockland Sanitary <br />District should be approved. The Board of Commissioners adopted a resolution to that effect. <br />Therefore, the representatives of the State Board of Hea~hh stated that they would recommend to th~ <br />State Board of Health at their next regular meeting that the proposed Rockland Sanitary Distwict <br />be approved. <br /> THEREFORE, BE IT RESOLVED FURTHER, that in the opinion of the State B~d of Health of the <br /> State of North Carolina, the territory described in said petition should be created as a <br /> sanitary district, and it is for ~he best interest of the residents and inhabitants of the said <br /> district for the purpose of preserving and promoting the public health that the said sanitary <br /> district be created, a nd that same be rand is hereby created and established as a sanitary distric <br /> all in accordance with and pursuant to provisions of Chapter 130, Article 12, <br /> General Statu_te__s Of ~rth _Carol i n~.s_1957._ <br /> Beginning at a Black Jack O ak in the north line of Lot No. 31, Block A of Rockland, corner <br /> of ~C~. a~-. rue. ~C!~un. ty Hgme..prop.er_ty $~.d Annie K.Tu.r.ner~pr.oRert~,.and belinD designer.e4 as.
