356 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular session <br />at the Courthouse in Concord, North Carolina on Tuesday, November 13, 1979 at <br />9:30 A.M. <br /> Present - Chairman: Troy R. Cook <br /> Commissioners: Ralph C. Bonds <br /> Marcelle Milloway <br /> James W. Lentz <br /> J. Ray Allen <br /> The invocation was given by the Reverend Fred J. Harmon of the Bayless <br />Memorial Presbyterian Church. <br /> UPON MOTION of Commissioner Lentz, seconded by Chairman Cook and unanimously <br />carried, the minutes of October 8, 1979 were approved. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Lentz and <br />unanimously carried, Frankie F. Small was appointed Clerk to the Board of County <br />Commissioners. <br /> UPON MOTION of Chairman Cook, seconded by Commissioner Milloway, the Board <br />approved the addition of a $50 deductible for all in-hospital admissions to the <br />employee hospitalization insurance program. The vote was as follows: Chairman <br />Cook and Commissioners Bonds, Milloway, and Allen voting for and Commissioner Lentz <br />voting against. Charles D. McGinnis, County Manager, was authorized to make <br />arrangements with the Health Department for annual physicals to be available to all <br />County employees at no cost to the employee. <br /> Chairman Cook excused himself from. the meeting at this time. Vice Chairman <br />Bonds presided in his absence. <br /> Vice Chairman Bonds stated that this was the day and hour set'for a public <br />hearing on the closing of Wolf Meadow School Road and asked if there was anyone <br />present who would like to speak for or against the closing of this public road. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Allen and unanimously <br />carried, the Board adopted the following resolution to permanently close Wolf Meadow <br />School Road in accordance with Section 153A-241 of the North Carolina General Statutes. <br /> <br />WHEREAS, the Wolf Meadow School Road is a secondary road, previously maintained by <br />the State of North Carolina, which connects U. S. Highway 29 and Roberta Mill Road <br />in Cabarrus County, North Carolina, said Wolf Meadow School Road having been <br />formerly designated under the State Road secondary system as State Road 1535; and <br /> <br />WHEREAS, said Wolf Meadow School Road was constructed for the primary purpose of <br />providing access to the Wolf Meadow Elementary School located between U. S. 29 <br />and Roberta Mill Road; and <br /> <br />WHEREAS, this Board of County Commissioners, at a meeting duly convened and held <br />on March 9, 1978, determined that it was in the best interests of the county and <br />its citizens to request the North Carolina Department of Transportation to abandon <br />and permanently close Wolf Meadow School Road and by resolution unanimously <br />adopted at said meeting, this Board requested the North Carolina Department of <br />Transportation to abandon and' permanently close Said road, such abandonment and <br />closing to have been effective upon the construction of suitable access to Wolf <br />Meadow Elementary School utilizing State Road 1541 from Roberta Mill Road plus <br />an extension of said State Road 1541; and <br /> <br />WHEREAS, this Board of County Commissioners has now been advised in writing by <br />the Division Engineer for the Department of Transportation of the State of North <br />Carolina that the said Wolf Meadow School Road was abandoned by the Board of <br />Transportation in official session on May il, 1979 and that the Department of <br />Transportation has constructed and completed a new access road in accordance <br />with applicable state specifications to provide suitable and adequate access to <br />Wol~ Meadow Elementary School along an extension of State Road 1541; and <br /> <br />WHEREAS, since Wolf Meadow School Road has been abandoned by the North Carolina <br />Department of Transportation and is no longer being maintained by state funds, <br />it would be encumbent upon Cabarrus County to allocate and provide funds for the <br />maintenance of said Wolf Meadow School Road in order to keep it open to the <br />public, which such allocation and provision of funds would be financially burden- <br />some to Cabarrus County without a good cause shown; and <br /> <br />WHEREAS, Wolf Meadow School Road is no longer necessary for the use of the <br />general public or necessary for ingress or egress by any adjoining landowners <br />who do not have some other adequate means of access to their respective properties; <br />and <br /> <br />WHEREAS, Section 153A-241 of the North Carolina General Statutes authorizes the <br />Board of County Commissioners to permanently close a public road after having held <br />a public hearing on the matter; <br /> <br /> <br />
