503 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M. <br />on Thursday, March 1, 1984, at the County Courthouse in Concord, North <br />Carolina, for a public hearing regarding proposed Zoning Atlas and Text <br />Amendments and Private Road Standards for'Cabarrus County. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Archie Y. Barnhardt <br /> Marcelle Milloway <br /> Kenneth F. Payne <br /> Absent - Commissioner : J. Harold Nash <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. James F. Owens, Assistant Planning Director, reviewed the <br />location of each of the areas proposed for rezoning. Public input was <br />received by the Board regarding the proposed amendments prior to action <br />by the Board of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) Correction of mapping error, township 4, map 5611. <br /> <br /> Mr. F. A. Rankin explained that property belonging to Mr. Jack Alston <br />on Highway 73 had been zoned ARR by the Board of Commissioners at a meeting <br />on January 5, 1982, but had been incorrectly mapped as R-40. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Payne <br />and unanimously carried, the Board moved that property located in Township <br />4, Map/PIN 5611-05-3296, 15-7482, and 25-4194, be made to read ARR in the <br />Zoning Atlas as approved by the Board on January 5, 1982. <br /> <br />(2) <br /> <br />Petition 84-01, Mr. & Mrs. Herman Childers, Township 4, Northeast <br />corner of Lane street and Wright Avenue. Map/PIN 5624(19)-61-5597, <br />61-6551. Wishes to rezone from C-1 to C-3. The Planning Board <br />unanimously denied this request, feeling that an eventual traffic <br />problem would result and also wanted to perserve the character of <br />the surrounding neighborhood. <br /> <br /> A petition containing thirty-seven (37) signatures was received by the <br />Board in opposition to the rezoning of the property from C-1 to C-3. <br /> Mr. and Mrs. Herman Childers requested the rezoning, stating that <br />the warehouse would be used for the temporary storage of such products as <br />soaps, detergents, and softeners before delivery to their customers by <br />Mr. Childers and would create no traffic problem in the neighborhood. <br />Mrs. Childers stated they had no plans to sell the property although they <br />could not guarantee that it would not be resold at some point in the future. <br />In response to the petition opposing the rezoning, Mrs. Childers stated <br />she had found that only five of the persons listed on the petition lived <br />in the neighborhood. Mrs. Childers further stated that she had talked with <br />thirteen (13) families living in Cabarrus County within one block of her <br />property and had found one family who signed the petition and three <br />families who were opposed to the rezoning. In conclusion, Mrs. Childers <br />noted that the Board of Commissioners had rezoned property within one-half <br />block of her property from R-9 to C-3 in November, 1982. <br /> Ms. Teresa Moffitt, adjoining property owner, and Ms. Betty Williams, <br />resident of Lane Street, supported the rezoning of the property. <br /> Mr. Rick Towell of the Kannapolis Sanitary District Fire Department <br />stated that he and Mr. James L. Pharr, Fire Marshal, had reviewed the data <br />sheets on the products to be stored in the warehouse and had found nothing <br />that would be more hazardous than a house fire. <br /> Motion was made by Commissioner Payne and seconded by Chairman <br />Lentz to approve Petition 84-01 to rezone the property from C-1 to C-3 <br />with Commissioner Payne and Chairman Lentz voting for and Commissioners <br />Milloway and Barnhardt voting against. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Lentz with <br />Commissioners Payne and Barnhardt and Chairman Lentz voting for and <br />Commissioners Milloway voting against, the Board deferred the matter <br />until the regular Board meeting on Monday, March 5, 1984. <br /> <br />(3) <br /> <br />Petition 84-02, Roy L. Biggerstaff, township 4, corner of Mooresville <br />Road and Miller Street. Map/PIN 5613(05)-29-9131, 29-1251. Wishes <br />to rezone from C-1 to RMF-6. Planning Board voted unanimous to grant <br />this rezoning request. <br /> <br /> <br />
