4O4 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in <br />Courtroom 2 of the County Courthouse in Concord, North Carolina, on <br />Thursday, April 3, 1986, at 7:00 P.M. for a public hearing regarding <br />proposed Zoning Atlas Amendments. <br /> Present Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the County Planning staff, reviewed <br />the location of the areas proposed for rezoning. Public input was <br />received regarding the proposed amendments prior to action by the Board <br />of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 86-06. Lake Shore Estates, Inc., off Highway 601 at <br />Concord Speedway, township 10, Map/PIN 5547-60-2559, 61-3221. <br />Wishes to rezone from ARR to I-2/RDO. The Board voted 3-2 to <br />approve this petition. <br /> <br /> Mr. Cecil Jenkins, Attorney representing Lake Shore Estates, Inc., <br />spoke in support of the rezoning of the Concord Motor Speedway, stating <br />that the I-2 zone would represent the best use of the land. He stated <br />the rezoning request was an economic impact decision for Cabarrus County <br />and cited the Concord Motor Speedway as a main tourist attraction in the <br />county. According to Mr. Jenkins, approximately 200,000 persons <br />attended events at the Speedway last year which resulted in a $10 to $20 <br />million economic impact to Cabarrus County. Mr. Jenkins explained the <br />Speedway is operating as a non-conforming use in the ARR zone and the <br />rezoning was necessary in order for the Speedway to expand. He <br />contended the Concord Motor Speedway is an appropriate site for the I-2 <br />zone as Highway 601 is a main artery highway, the surrounding property <br />is undeveloped, no close proximity residential developments exist in the <br />area, water service is available, and the waste treatment plant is <br />located nearby to provide sewer services. In conclusion, Mr. Jenkins <br />asked for approval of the rezoning request for the economic development <br />of Cabarrus County. <br /> Mr. A. C. Sossamon, resident of the area, stated he owned property <br />one-half mile from the racetrack and was not opposed to the I-2 zone for <br />the property. <br /> Mr. Samuel F. Davis, Jr., Attorney representing persons in the <br />Flowe's Store Community who objected to the rezoning, presented to the <br />Board a petition containing 187 signatures of residents opposing the <br />rezoning. Stating the issue under consideration was zoning, Mr. Davis <br />reviewed the permitted uses and statements of intent for the ARR and I-2 <br />zones. He stated the I-2 zone would not be consistent with the County's <br />Land Use Plan and stressed that the I-2 zone would not be appropriate <br />with the other land uses in the area. He further emphasized that <br />rezoning the property to I-2 would constitute spot zoning. Mr. Davis <br />pointed out that the Speedway was built in the ARR zone and was <br />currently operating as a conditional use. He contended that it would <br />not be appropriate to promote heavy industrial uses along Highway 601 as <br />it would impose heavy traffic in an area where a four-lane highway is <br />not readily accessible. According to Mr. Davis, the Speedway had <br />stifled residential development in the area and had caused a negative <br />economic impact to Cabarrus County as area property owners had received <br />property tax discounts because of the Speedway. In conclusion, Mr. <br />Davis stated that industrial development should occur in those areas <br />where the infrastructure currently exists and asked that the Board <br />refuse the rezoning of the Concord Motor Speedway to I-2. <br /> Mr. V. H. Taylor, property owner, disagreed with the statement by <br />Mr. Davis that the County had lost money because of the reduction of tax <br />values of property adjacent to the Speedway. <br /> Mr. Fred Daniels, resident of the area, spoke in support of the <br />Concord Motor Speedway, stating it was a clean family operation and was <br />needed to generate more capital for that end of the county. <br /> <br /> <br />
