38 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session at the County Courthouse in Concord, North Carolina, on Thursday, <br />January 26, 1989 at 5:30 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin and <br />unanimously carried, the Board authorized the submission of a grant request <br />in the amount of $30,000.00 to the Trustees of the Charles A. Cannon <br />Charitable Trust No. One and No. Two to continue the project of providing <br />funds for the Charles A. Cannon Memorial Library - Kannapolis Branch for <br />the purpose of purchasing library materials. <br /> UPON MOTION of Commissioner Simmons, seconded by Chairman Lentz with <br />Commissioners Simmons, Moss, and Hamby and Chairman Lentz voting for and <br />Commissioner Melvin voting against, the Board accepted the following <br />Pretreatment Agreement between Cabarrus County and the City of Concord as <br />submitted by Mr. Fletcher L. Hartsell, Jr., County Attorney. <br /> <br />STATE OF NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />PRETREATMENT AGREEMENT <br /> <br /> THIS AGREEMENT made and entered into this day of , <br />1989, by and between CABARRUS COUNTY, hereinafter referred to as COUNTY, <br />and the CITY OF CONCORD, hereinafter referred to as CONCORD; <br /> <br />WI TNES SETH : <br /> <br /> THAT, WHEREAS, <br />treatment services <br />regulations; and <br /> <br />these parties are engaged <br />in accordance with state <br /> <br />in providing wastewater <br />and federal laws and <br /> <br /> WHEREAS, the COUNTY provides and maintains a wastewater collection <br />system, over which the COUNTY controls the use and connections thereto; and <br /> <br /> WHEREAS, CONCORD provides and maintains the treatment facilities and <br />is the NPDES 0036269 permittee; and <br /> <br /> WHEREAS, CONCORD is identified by the State Department of Natural <br />Resources and Community Development and the Environmental Protection Agency <br />as being responsible for the Publicly Owned Treatment Works(POTW); and <br /> <br /> WHEREAS, CONCORD is required by the state and federal regulations to <br />control all non-domestic wastewater discharges into the Rocky River <br />Regional Wastewater Treatment Plant by development and implementation of a <br />pretreat~ent program; and <br /> <br /> WHEREAS, the State Department of Natural Resources and Community <br />Development is requiring an inter-jurisdictional pretreatment agreement, <br />with each local jurisdiction served, for the implementation and enforcement <br />of the pretreatment program, by CONCORD within the COUNTY, in accordance <br />with 40 CFR Section 403 of the Federal Regulations. <br /> <br />NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br />Pretreatment and Surcharge Program Agreement <br /> Article I <br /> Section A- Pretreatment_Program <br /> <br />1) <br /> <br /> CONCORD agrees to provide, implement, and maintain an approved <br />pretreatment program as required by state and federal laws and <br />regulations for the control of non-domestic discharges, in accordance <br />with 40 CFR Section 403 of the Federal Regulations. <br /> <br />2) <br /> <br /> As part of the pretreatment program, CONCORD's Sewer Use <br />Ordinance, Chapter 12 of the City Code adopted December 10, 1987, <br /> <br /> <br />
