63 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in emergency <br />session at the County Courthouse in Concord, North Carolina, on Thursday, <br />March 16, 1989, at 3:00 P.M. The purpose of the meeting was to convene in <br />executive session in order to confer with the County Attorney about the <br />acquisition of real property. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Absent - Con~nissioner: Billy J. Simmons, Jr. <br /> Chairman Lentz announced that the meeting had been called because of <br />unexpected circumstances that required immediate consideration by the Board <br />of Commissioners. He further stated that the matter involved property for <br />a County project which the Board had been working on for a number of years. <br /> Mr. Michael M. Ruffin, County Manager, reported that he had spoken with <br />Commissioner Simmons' wife at his home and that she had advised that <br />Commissioner Simmons was out of town and had left the motel where he had <br />stayed the previous evening. Mr. Ruffin also called Mr. Simmons' business <br />answering service in attempting to notify him personally. The local news <br />media was also notified and representatives of THE CONCORD TRIBUNE, THE <br />DAILY INDEPENDENT, CABARRUS NEIGHBORS, and W E G O Radio were present for <br />the meeting. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin and <br />unanimously carried, the Board moved to go into executive session to discuss <br />potential land acquisition and for consultation with counsel. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby and <br />unanimously carried, the executive session was terminated. <br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and <br />unanimously carried, the Board authorized the County Attorney to send a <br />Notice of Intent to File Condemnation Action pursuant to North Carolina <br />General Statutes Section 40A-40 to Dr. J. Baxter Caldwell, Mrs. Louise G. <br />Caldwell, and Landex, Inc., in care of Mr. William Burk, President, <br />notifying them of the Board's intention to initiate condemnation proceedings <br />to acquire approximately 300 acres of property west of 1-85 and north of <br />Rocky River, current record title to which is in the name of J. Baxter <br />Caldwell, for the purpose of an airport facility (a portion of the site <br />selected by this Board on November 17, 1986). The Board authorized the <br />tender of compensation of $5,000.00 per acre, but not to exceed <br />$1,500,000.00. The approximate description of the property is as follows: <br /> <br /> So much of that property in No. 2 Township, Cabarrus County, <br />North Carolina identified as PIN 4589.02-65-8898 in the Cabarrus <br />County tax records as is adjacent to and north of Rocky River and <br />adjacent to and west of Interstate Highway 85 (I-85), containing <br />approximately 300 acres, more or less, as computed for a map dated <br />May 13, 1988, prepared by Cabarrus County as assembled from deeds <br />of public record, aerial photography and other pertinent plats and <br />maps, and identified as the Site of Proposed Cabarrus County <br />Airport, and generally described as follows: <br /> <br /> BEGINNING at a point in the center of Rocky River, a corner of <br />J.
