<br />February 27, 2006 - Recessed Meeting <br /> <br />Page <br /> <br />S17 <br /> <br />The Board of Commissioners for the County of Cabarrus met in recessed <br />session in Cabarrus Room A at the Cabarrus Arena and Events Center at 4751 <br />Highway 49 N, Concord, on Monday, February 27, 2006, at 6:00 p.m. <br /> <br />Present - Chairman: Robert W. Carruth <br />Vice Chairman: Joni D. Juba <br />Commissioners: Carolyn B. Carpenter <br />Robert M. Freeman <br />Coy C. Privette <br /> <br />Also present were John D. Day, County Manager; Richard M. Koch, Acting <br />County Attorney; Mike Downs, Deputy County Manager; Pam Dubois, Deputy County <br />Manager; and Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Carruth called the meeting to order at 6:10 p.m. <br /> <br />The following persons were also present: <br /> <br />Cabarrus County Schools Chair Liz Poole; Vice Chair Grace <br />Mynatt; Board Members Cindy Fertenbaugh, Wayne williams and Lynn <br />Shue; Dr. Harold Winkler, Superintendent; Jim Amendum, Assistant <br />Superintendent; Gary Masters, Construction Director; and Jeanette <br />Trexler, Public Relations. <br /> <br />Kannapolis City schools - Chairman <br />Rickard; Board Members Millie Hall <br />Anne Byerly, Superintendent, and <br />Business Operations. <br /> <br />Lee Efird; vice Chair Danita <br />and Charles Mitchell; Dr. Jo <br />will Crabtree, Director of <br /> <br />Commissioner Privette gave the invocation. <br /> <br />Chairman Carruth recessed the meeting for a short period of time. He <br />reconvened the meeting at 6:20 p.m. <br /> <br />Proposed Adequate Public Facilities Ordinance <br /> <br />Chairman Carruth recognized Jonathan Marshall, Commerce Director, for a <br />presentation concerning the Adequate Public Facilities Ordinance (APFOl. <br /> <br />Mr. Marshall gave a powerPoint presentation entitled "APFO Workshop" <br />that was presented at workshops in December by the consultant, Mark White of <br />White and Smith, LLC. He reviewed the general concepts of an APFO, the <br />background of APFO, how it has been enforced in Cabarrus County and the <br />differences in the current ordinance and the proposed ordinance. He stated <br />the County looks at adequate facilities in terms of financial issues, <br />specifically funding new schools. The following items were highlighted during <br />the presentation: <br /> <br />. The APFO applies to subdivisions, multi-family development and mobile <br />home parks. Minor subdivisions and developments such as retirement <br />homes are exempt from school adequacy requirements. <br />. Mitigation is a voluntary contribution that adds capacity. It can be in <br />the form of direct payment, donation of land or infrastructure <br />improvements. <br />. County staff works with the Schools to determine the Student Generation <br />Rate (number of students per household). A meeting was recently held <br />with an individual who will be looking at developing a projection and <br />estimation model that will use local and historic data to better <br />predict the number of school aged children expected from differing <br />housing units. <br />. Available Capacity is determined by a formula based on Existing <br />Capacity and Planned Capacity less Existing Demand and Committed <br />Development. <br />. Phasing of developments may be required to match school construction. <br />. School adequacy will be tested by high school feeder districts rather <br />than countywide. All three levels, including- elementary, middle and <br />high school, will be tested. <br />. Consent Agreements for developments, including those within the <br />municipalities of Concord and Kannapolis, are brought to the Board when <br />school facilities are determined to be inadequate. The Agreements <br />specify the action a developer will take to address those inadequacies. <br /> <br />Mr. Marshall responded to a number of questions by members of the three <br />boards. He addressed the following issues: (1) Schools IS-Year Facility Plan <br />and the acceptance of donated land for schools identified in that Plan; (2) <br />
