<br />April 17, 2006 - Regular Meeting <br /> <br />Page <br /> <br />558 <br /> <br />The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, April 17, 2006, at <br />6:30 p.m. <br /> <br />Present - Chairman: Robert W. Carruth <br />Vice Chairman: Joni D. Juba <br />commissioners: Carolyn B. Carpenter <br />Robert M. Freeman <br />Coy C. Privette <br /> <br />Also present were John D. Day, County Manager; Richard M. Koch, Acting <br />County Attorney; Frankie F. Bonds, Clerk to the Board; and Kay Honeycutt, <br />Deputy Clerk to the Board. <br /> <br />Chairman Carruth called the meeting to order at 6:31 p.m. <br /> <br />Girl Scout Troop 2083 of Center United Methodist Church conducted the <br />Flag Ceremony. Scouts participating in the ceremony were: Amy Goggin, <br />Alison Criscoe, Morgan Garrett, Anna Truay, Tricia White, and Elisha Cole. <br /> <br />Pastor Bill Cranfield of Friendship United Methodist Church gave the <br />invocation. <br /> <br />(A) APPROVAL OF CORRECTION OF MINUTES <br /> <br />vice Chairman Juba made a motion, seconded by Commissioner Carpenter, <br />to approve the minutes as written for the following meetings: January 27, <br />February 6, February 9, February 20, February 27 and March 11, 2006. <br /> <br />Commissioner Privette questioned that portion of the February 20th <br />minutes regarding the correction to the minutes of September 19, 2005. The <br />Board had approved a correction to delete the word "contract" and insert <br />"selection of construction manager at risk". The corrected sentence read as <br />follows: The Attorney with the lOG had recommended that Commissioner Juba not <br />vote on the selection of the construction manager at risk and she had recused <br />herself from that vote. commissioner Privette stated he had been advised <br />earlier this date (April 17) that the Board should have a letter from the <br />Institute of Government (lOG) verifying the recommendation and that the <br />letter should be attached to the minutes to give the County protection in the <br />event of a lawsuit. He stated that portion of the February 20th minutes <br />should not be approved until official communication was received from the <br />Institute of Government. <br /> <br />Chairman Carruth stated the sentence read by Commissioner Privette was <br />part of the summary of the comments made by the Attorney for Vice Chairman <br />Juba's company during the "Informal Public Comments" portion of the meeting <br />on September 19, 2005. He said a transcript of those comments had been <br />provided to the Board by the Clerk who had requested the correction to the <br />minutes. <br /> <br />The Clerk confirmed that she had made a mistake in preparing the <br />minutes of September 19 and had requested the correction. She stated a <br />transcript of the comments made by the attorney (June Allison) during the <br />meeting on September 19, 2005, had been included in the Agenda for the <br />February 20th meeting. At that meeting, the Board had approved the requested <br />correction to the September 19th minutes. <br /> <br />There was discussion by the Board regarding the issuance of opinions by <br />professors at the Institute of Government and the recording of comments made <br />by individuals during the public comments period. <br /> <br />Commissioner Carpenter amended her second and motion was made to <br />approve the minutes with the exception of that portion of the February 20th <br />minutes that was in question. Commissioner Privette seconded the motion. The <br />motion carried with Commissioners Carpenter, Privette and Freeman voting for <br />and Chairman Carruth and vice Chairman Juba voting against. The minutes <br />approved by the Board were as follows: January 27, February 6, February 9, <br />February 27 and March 11, 2006. <br /> <br />John Day, County Manager, questioned the need for <br />statements made by members of the public during the public <br />in order for the minutes to be done. <br /> <br />staff to verify <br />comments section <br /> <br />Vice Chairman Juba asked Commissioner Privette to clarify his request. <br />
