April 26, 2004 Page 434 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Commissioners' Meeting Room at the Cabarrus County <br />Governmental Center in Concord, North Carolina on Monday, April 26, 2004, at <br />11:00 a.m. <br /> <br />Present - Chairman: Robert M. Freeman <br /> Vice Chairman: Richard D. Suggs <br /> Commissioners: Carolyn B. Carpenter <br /> Coy C. Privette <br />Absent - Commissioner: Robert W. Carruth <br /> <br /> Also present were John D. Day, County Manager; Marilyn D. Porter, <br />County Attorney; and Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Freeman called the meeting to order at 11:05 a.m. <br /> <br />Commissioner Privette gave the invocation. <br /> <br />Addition to Agenda <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board voted to add to the Agenda a <br />Consent Agreement between Howard Hurlocker, developer, and Cabarrus County. <br /> <br />Consent Agreement - Odell Place Development <br /> <br /> Mr. Rodger Lentz, Planning Manager, presented the proposed Consent <br />Agreement with Howard Hurlocker for the development of the Odell Place <br />Subdivision with five single family lots located at Barnette and Odell School <br />Road. He explained that Mr. Hurlocker had developed five lots in the project <br />as a minor subdivision and is now adding five lots that will be subject to <br />the adequate public facilities provisions. Mr. Lentz stated Mr. Hurlocker <br />has agreed to contribute $1,008.00 per lot to address school adequacy issues. <br />Further, the Planning and Zoning Commission has approved the subdivision <br />subject to the developer entering into a Consent Agreement with Cabarrus <br />County to address the adequate public facilities ordinance requirements. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner <br />Carpenter and unanimously carried, the Board approved the Consent Agreement <br />between Cabarrus County and Howard Hurlocker for the Odell Place Development, <br />including the payment of $1,008.00 per lot to advance the adequacy of public <br />schools, with payment to be made at the issuance of Building Permitting. <br />Further, the Board authorized the County Manager to execute the Consent <br />Agreement on behalf of Cabarrus County. <br /> <br />Closed Session <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs <br />and unanimously carried, the Board moved to go into Closed Session to consult <br />with the Attorney to preserve the attorney-client privilege as authorized by <br />North Carolina General Statute 143-318.11(a) (3) . Further, the Board invited <br />Attorney Fletcher L. Hartsell, Jr., and Commerce Director Jonathan Marshall <br />to join the Board in Closed Session. ' <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Vice Chairman Suggs <br />and unanimously carried, the Board moved to come out of the Closed Session. <br /> <br />No action was reported from the Closed Session. <br /> <br />Recess of Meetin~ <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board voted to recess the meeting at <br />12:50 p.m. until 10:00 a.m. on Tuesday, April 27, 2004, at the Office of <br />Hartsell and Williams, P.A., 71 McCachern Boulevard, Concord, North Carolina. <br /> <br />Clerk to the Board <br /> <br /> <br />
