July 7, 2003 Page 182 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Multipurpose Room at the Cabarrus County Governmental Center <br />in Concord, North Carolina on Monday, July 7, 2003, at 7:30 p.m. <br /> <br />Present - Chairman: Robert M. Freeman <br /> Vice Chairman: Richard D. Suggs <br /> Commissioners: Carolyn B. Carpenter <br /> Robert W. Carruth <br /> Coy C. Privette <br /> <br /> Also present were Mr. John D. Day, Interim County Manager; Mr. Fletcher <br />L. Hartsell, Jr., County Attorney; Mr. Don Cummings, Human Resources <br />Director; and Mrs. Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Freeman called the meeting to order at 7:34 p.m. <br /> <br />Commissioner Carruth gave the invocation. <br /> <br /> Chairman Freeman stated the Board would be interviewing two individuals <br />for the Tax Administrator position during the Closed Session. <br /> <br />County Attorney Position <br /> <br /> Commissioner Carruth requested reconsideration of the Board's action on <br />June 30, 2003, concerning the county attorney and/or staff attorney position <br />and the County's continued relationship with Mr. Hartsell (County Attorney). <br />He cited confusion as to the action taken by the Board and the need to <br />clarify that action. <br /> <br /> Commissioner Privette stated that the motion he made on June 30th was <br />for the Interim County Manager in consultation with the County Attorney to <br />secure a full-time staff attorney for Cabarrus County. He said it was the <br />intent of his motion that the full-time staff attorney would be the county <br />attorney. Further, Commissioner Privette pointed out that outside attorneys <br />could continue to be secured for specialized legal counsel as determined by <br />the Board. <br /> <br /> Chairman Freeman and Vice Chairman Suggs, who voted in favor of the <br />motion on June 30, indicated their agreement with the clarification offered <br />by Commissioner Privette as to the intent of the June 30tn motion. There was <br />no motion to reconsider the county attorney/staff attorney issue. <br /> <br />Closed Session <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board moved to go into Closed Session to discuss <br />personnel matters as authorized by North Carolina General Statute (NCGS) 143- <br />318.11(a) (6), specifically to review the qualifications of prospective County <br />employees; to discuss matters relating to the location of a business in the <br />county as authorized by NCGS 143-318.11(a) (4); and to instruct staff or <br />negotiating agent concerning the position to be taken by the public body in <br />negotiating material terms of a contract or proposed contract regarding the <br />acquisition of real property in regards to the convention center project as <br />authorized by NCGS 143-318.11(a) (5). <br /> <br /> The Clerk left the meeting during the Closed Session. Mr. Don <br />Cummings, Human Resources Director, recorded the minutes for a portion of the <br />Closed Session pertaining to personnel matters as well as the remainder of <br />the meeting after the Board reconvened in open session. <br /> <br /> UPON MOTION of Commissioner Carpenter, seconded by Commissioner <br />Privette and unanimously carried, the Board moved to come out of the Closed <br />Session. <br /> <br />Adjournment <br /> <br /> There being no further business to <br />Freeman adjourned the meeting at 10:43 p.m. <br /> <br />come before the <br /> <br />Board, Chairman <br /> <br />Clerk to the Board <br /> <br /> <br />
