442 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Multipurpose Room at the Cabarrus County Governmental Center <br />in Concord, North Carolina on Monday, May 8, 2000, at 6:30 p.m. <br /> <br />Present - Chairman: Arne L. Fennel <br /> Vice Chairman: Carolyn B. Carpenter <br /> Commissioners: Jeffrey L. Barnhart <br /> Sue B. Casper <br /> Coy C. Privette <br /> <br /> Also present were Mr. Frank W. Clifton, Jr., County Manager; Mr. <br />Michael R. Burgher, Attorney with Hartsell, Hartsell & White, P.A.; and Mrs. <br />Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Fennel called the meeting to order. <br /> <br />Approval of the Aqenda <br /> <br /> Chairman Fennel listed the following Agenda items: 1) Proposed Moss <br />Farms Development; (2) Resolution Authorizing Condemnation of Property; and <br />(3) Contract for Jail Inmate Health Services. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board approved the Agenda with the items as listed. <br /> <br />Condemnation of ProDert¥ <br /> <br /> Mr. Clifton presented the proposed "Resolution Authorizing Condemnation <br />Action" on approximately 62.40 acres on Cox Mill Road for a new school site. <br />He stated staff had determined that this property was the best of the three <br />sites proposed in that area for the new school. Approximately 40 acres of <br />the property is usable with the remaining property in the floodplain. In <br />conclusion, Mr. Clifton stated the owners have a purchase contract in the <br />amount of $900,000.00 on the property. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Chairman Fennel and <br />unanimously carried, the Board adopted the following Resolution and approved <br />the appropriate budget amendments associated with the acquisition of the <br />property. <br /> Resolution No. 2000-15 <br /> <br />RESOLUTION AUTHORIZING CONDEMNATION ACTION <br /> <br /> WHEREAS, the County of Cabarrus is undertaking acquisition activities <br />necessary for the construction of a public school and other needed public and <br />general utility improvements for the Cabarrus County School System (The Cox <br />Mill Road Project); and <br /> WHEREAS, in order to provide for the necessary and expedient purchase <br />of real property designated to be acquired for the Cox Mill Road Project, the <br />County of Cabarrus has negotiated with the property owners in an attempt to <br />acquire the necessary property by negotiation in accordance with state law; <br />and it appears that negotiations will not be successful in acquiring the <br />needed property; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOAR/) OF COUNTY COMMISSIONERS OF <br />THE COUNTY OF CABARRUS that the attorneys for the County of Cabarrus, the law <br />firm of Hartsell, Hartsell & White, P.A., be, and hereby are, authorized to <br />institute a condemnation action to acquire the following property: PROPERTY DESCRIPTION: <br /> The approximately 62.40 acres, plus or minus, located on the East side <br /> of Cox Mill Road. <br /> That tract of land being more particularly described in Deed Book 699, <br /> Page 19, of the Cabarrus County Register of Deeds Office and bearing <br /> tax I.D. #4680-32-1476. <br /> OWNERS AND OTHER INTERESTED PARTIES: <br /> George Thomas Benton and wife, <br /> Patricia Pennington Benton, and <br /> Providence Court, L.L.C. <br /> A North Carolina Limited Liability Company <br /> THIS RESOLUTION is effective as of the 8th day of May, 2000. <br /> <br />ATTESTED <br />/s/ Frankie F.
