4O5 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session in the Tax Assessor's Conference Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Monday, May 8, 1995, at 5:30 P.M. <br /> <br />Present <br /> <br />Absent - <br /> <br />Chairman: Jeffrey L. Barnhart <br />Commissioners: Sue B. Casper <br /> Dr. Franklin C. Niblock, Jr. <br />Vice-Chairman: Arne L. Fennel <br />Commissioner: Kenneth Olio-Mills <br /> <br /> Also present were Mr. John V. Witherspoon, County Manager; Mr. John Day, <br />Budget Officer/Area Manager; Mr. Don Moorhead, Personnel Director; and Mrs. <br />Frankie F. Bonds, Clerk to the Board. <br /> <br />Chairman Barnhart called the meeting to order at 5:30 P.M. <br /> <br />Agreements with the Town of Harrisburg <br /> <br /> Mr. Witherspoon presented two agreements between Cabarrus County and the <br />Town of Harrisburg for consideration by the Board. These documents will <br />formalize policies currently in place by the two units of government. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Niblock with <br />Chairman Barnhart and Commissioners Niblock and Casper voting for, the Board <br />approved the following two documents, "Agreement to Supply Treated Water" and the <br />"Reciprocal Agreement for Water and Sewer Connections and Related Matters Between <br />the Town of Harrisburg and Cabarrus County". <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />AGREEMENT TO SUPPLY <br />TREATED WATER <br /> <br /> THIS AGREEMENT, of Interlocal Cooperation, pursuant to Article <br />20 of Chapter 160A of the General Statutes of North Carolina, made <br />and entered into this 8th day of May, 1995, by and between the TOWN <br />OF HARRISBURG, North Carolina (hereinafter referred to as <br />"H~RRISBURG"), and CABARRUS COUNTY (hereinafter referred to as <br />"CABARRUS"). <br /> W I T N E S S E T H: that -- <br /> WHEREAS, CABARRUS operates a public water system which <br />includes, but is not limited to, water transmission and distribution <br />here; and <br /> WHEREAS, HARRISBURG operates a public water system which <br />includes, but is not limited to, water transmission and distribution <br />here; and <br /> WHEREAS, by Agreement dated January 22, 1993, (the "HARRISBURG <br />LOOP AGREEMENT") HARRISBURG, CABARRUS and the City of Concord <br />agreed, among other things, as follows: <br /> Additional Undertakings. Upon completion of the HARRISBURG <br />LOOP, the parties agree as follows: <br /> (a) HARRISBURG shall disconnect its existing <br /> wells and purchase all treated water from <br /> CABARRUS at that rate and upon those terms set <br /> forth in a separate agreement executed by and <br /> between CABARRUS and HARRISBURG (the "Treated <br /> Water Agreement") which, among other things, <br /> shall provide that CABARRUS shall bill HARRISBURG <br /> on the total volume of HARRISBURG's individual <br /> customer water meter readings. <br /> WHEREAS, the HARRISBURG LOOP Connector has now been completed <br />and CABARRUS desires to continue to sell treated water to HARRISBURG <br />and HARRISBURG desires to continue to purchase treated water from <br />CABARRUS. <br /> NOW, THEREFORE, in consideration of the premises herein, the <br />terms of the HARRISBURG LOOP Agreement, CABARRUS' prior and <br />continuing sale of treated water to HARRISBURG, and the mutual <br />covenants and agreements hereinafter set forth, CABARRUS and <br />HARRISBURG agree as follows: <br /> <br /> <br />
