417 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session in the Commissioners Meeting Room at the Cabarrus County Governmental <br />Center in Concord, North Carolina on Monday, January 6, 1992, at 6:30 P.M. <br /> Present - Chairman: Carolyn B. Carpenter <br /> Commissioners: William G. Hamby, Jr. <br /> Jeffrey L. Barnhart <br /> Kenneth F. Payne <br /> Billy J. Simmons, Jr. <br /> Also present were Mr. John V. Witherspoon, County Manager; Mr. Fletcher <br />L. Hartsell, Jr., County Attorney; and Mrs. Frankie F. Bonds, Clerk to the Board. <br /> Chairman Carpenter called the meeting to order at 6:33 P.M. <br /> The invocation was given by Dr. Hollis Miller of the St. James Lutheran <br />Church. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Payne and <br />~unanimously carried, the minutes of December 9, 1991, were approved as written. <br /> <br />UNFINISHED BUSINESS <br /> <br /> Commissioner Simmons nominated Dr. Nancy Randall for reappointment as the <br />Township 10/11 representative to the Planning and Zoning Commission. He also <br />nominated Mr. Alan Allison for appointment as the Township 3/4 representative <br />to replace Ms. Doris Barbee who did not wish to be considered for reappointment. <br /> Chairman Carpenter nominated Mr. Bob Smith for reappointment as an at- <br />large representative to the Planning and Zoning Commission. <br /> Commissioner Barnhart nominated Ms. Katherine Stafford, current alternate <br />member, for appointment as an at-large member of the Planning and Zoning <br />Commission. He also nominated Mr. Ken Parker for appointment as an alternate <br />member to fill the position currently held by Ms. Stafford. <br /> UPON MOTION of Commissioner Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the nominations were closed for regular members of the <br />Planning and Zoning Commission. <br /> The Board voted unanimously to reappoint Dr. Nancy Randall as the Township <br />10/11 representative to the Planning and Zoning Commission for a three-year term <br />ending December 31, 1994. <br /> The Board voted unanimously to appoint Mr. Alan Allison as the Township <br />3/4 representative to the Planning and Zoning Commission for a three-year term <br />ending December 31, 1994. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Carpenter and <br />unanimously carried, the Board deferred the nominations of Ms. Katherine <br />Stafford, Mr. Bob Smith, and Mr. Ken Parker to the Planning and Zoning Commission <br />until later in the meeting. <br /> Commissioner Simmons reported that the Board had received 47 applications <br />for appointment to .the Planning and Zoning Commission. Chairman Carpenter <br />expressed appreciation to all applicants for their interest in County government. <br /> UPON MOTION of Commissioner Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved the following "Interlocal Agreement Solid <br />Waste Management" agreement with the Town of Harrisburg subject to approval of <br />a similar agreement by the City of Kannapolis. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />INTERLOCAL AGREEMENT <br />SOLID WASTE MANAGEMENT <br /> <br /> THIS AGREEMENT, made and entered, into this day of , <br />1991, by and between Cabarrus County, a body politic and corporate in the State <br />of North Carolina (the "County"), and the Town of Harrisburg, a municipal <br />corporation having a ~harter granted by the State of North Carolina (the <br />"Municipality"); <br /> W I TN E S SETH: <br /> WHEREAS, the County is authorized by N.C. Gen. Stat. 153A, Article 15, and <br />the Municipality is authorized by N.C. Gen. Stat. 160A, Article 16, to establish <br />and contract for the operation of public enterprises in order to furnish services <br />to the public, and the County and the Municipality are also authorized by N.C. <br />Gen. Stat. 160A, Article 20, to enter into contracts or agreements with each <br />other to execute any undertaking involving the joint exercise or the exercise <br />by one for the other of any power, function, public enterprise, right, privilege <br />or immunity of local government; <br /> <br /> <br />
