-2- <br /> <br /> (B) That a public hearing was held upon the question of creating said sanitary <br /> district through representatives of the State Board of Health, to-wit: <br /> Mr. E. C. Hubbard, Principal Sanita~-~ Engineer, and Mr. W. S. McKimmon, <br /> District Sanitary Engineer, Sanitary Engineering Division, North Carolina <br /> State Board of Health, who were duly designated to hold said hearing, the same <br /> having been held in accordance with the publication of said notice on the 23rd <br /> day of January, 1951, at 7:00 p. m. in Martin's Grill, which is located within <br /> the boundaries of the proposed sanitary district. <br /> <br /> (C) That at said hearing, which was attended by approximately 10 influential citizens <br /> and persons residing within the proposed sanitary district, no one challenged <br /> any of the signatures on the petition containing the names of over 51% of the <br /> resident freeholders, and no one present expressed opposition to the proposed <br /> sanitary district; all voting in favor of the formation of said proposed district. <br /> <br /> THEREFORE, BE IT RESOLVED FURTHER, that in the opinion of the State Board of Health of <br />the State of North Carolina the territory described in said petition should be created as <br />a sanitary district, and that it is for the best interest of the residents and inhabitants <br />of the said district for the purpose of preserving and promoting the public health th-~t the <br />Samita~y district be created, and that same be and is hereby created and established as <br />a sanitary district, all in ~accordance with and pursuant to the provisions of Chapter 100, <br />Public Laws of 1927, and all the acts amendatory thereto; <br /> <br /> The said district as described in the said petition and resolutions heretofore passed <br /> <br />is hereby described and set out as follows, to-wit: <br /> <br /> Beginning at a point in the western line of the Southern Railroad right-of-way <br /> 150 feet north of the line of a new street near the antique shop and about <br /> 1050 feet north of the ce~terline of Mill Road; thence S 859° W, 330 feet to <br /> a point 250 feet from the western boundary of the Concord-Kannapolis Highway; <br /> thence parallel to said highway and 250 feet from its western boundary S 15½°, <br /> 650 feet; thence S 339° W 550 feet more or less to a point 150 feet north of <br /> the northern boundary of Mill Road and 150 feet west of the western boundary of <br /> School Street; thence in two courses parallel to School Street and 150 feet from <br /> it S 20° E, 370 feet and S 9° E, 536 feet to the centerline of Oak Ridge Drive <br /> (Also called Parkwood Street); thence S 6~° W, 1300 feet more or less to a <br /> point in the centerline of Pless Street 150 feet from the west boundary of <br /> School Street; thence parallel to School Street and 150 feet from it S 28 3/4° W, <br /> 816 feet to Tally's southern boundary; thence following said boundary and crossing <br /> School Street S 85° E, 385 feet to a point 150 feet east of its eastern boundary; <br /> thence parallel to it N 28 3/4° E, 1200 feet; thence S 83° E, 1200 feet; thence <br /> N 82° E, 510 feet more or less to a point in the eastern line of the Southern <br /> Railroad right-of-way, the northwest corner of the Dr. W. L. Ezzell home lot; <br /> thence following the common line of the Dr. W. L. Ezzell home lot and that of <br /> Dr. J. W. Ezzell, N 54½° E, 450 feet to the western line of Cannon Boulevard; <br /> thence following said western line S 3512° E, 235 feet to the southern line of <br /> Country Club Road; thence following the south line of this road in three courses <br /> N 29~° E, 750 feet, N 24° E, 500 feet and N 26° E, 615 feet to the center of <br /> <br /> <br />
