470 <br /> <br /> The Board reviewed the letter from Mr. David B. Roberts, Division <br />Engineer with the North Carolina Department of Transportation, regarding <br />that department's attempt to work out a solution for getting .25 mile of <br />Cessna Road (SR 1443) paved. This total road was included in the priority <br />paving program for 1975; however, the right of way could not be obtained <br />for the south .25 of a mile. This right of way has now been obtained, <br />but paving has not been completed. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board adopted a resolution supporting the paving <br />of the .25 mile of Cessna Road (SR 1443). This resolution is to be <br />forwarded to Mr. David B. Roberts of the North Carolina Department of <br />Transportation. <br /> Mr. Charles D. McGinnis, County Manager, reminded the Board of an <br />informal meeting with engineers of Henningson, Durham & Richardson, Inc., <br />at the company's office in Charlotte at 4:00 P.M. on Wednesday, January 4, <br />1984. This is to be an educational meeting to review items relating to <br />water and sewer in Cabarrus County. <br /> Chairman Lentz stated that the NACo Legislative Conference would be <br />held in Washington on March 16 - 20, 1984. The Board agreed to change <br />the regular meeting date of March 19, 1984, to March 21, 1984. <br /> Commissioner Nash stated that the next meeting of the Board of <br />Commissioners on the third Monday in January would be the anniversary of <br />the first meeting of the Court of Pleas and Quarter Sessions as the governing <br />board of Cabarrus County in 1793. He recommended that the Board open the <br />meeting on January 16, 1984, with a brief program in the Old Cabarrus <br />County Courthouse in commemoration of this event. The Board accepted <br />this recommendation and asked that Commissioner Nash prepare plans for <br />this ceremony. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt <br /> and unanimously carried, the Board adopted the following resolution. <br /> <br /> BE IT RESOLVED that the County Manager is hereby authorized to <br />execute the following Limitation of Use of the property contributed to <br />Cabarrus County and Rowan County by Cannon Mills for use as a park, the <br />park being located in Rowan County: <br /> <br /> "The property identified has been acquired or developed with <br />Federal financial assistance provided by the National Park Service <br />(formerly the Heritage Conservation Recreation Service) of the Department <br />of the Interior in accordance with the Land and Water Conservation Fund <br />Act of 1965, as amended, 16 U.S.C. Section 4601-5 et seq. (1970 ed.). <br />Pursuant to a requirement of that law, this property may not be converted <br />to other than public outdoor recreation uses (whether by transfer, <br />sale, or in any other manner) without the express written consent of <br />the Secretary of the Interior. By law, the Secretary shall approve such <br />conversion only if he finds it to be in accord with the then existing <br />comprehensive statewide recreation plan and only upon such conditions as <br />he deems necessary to assure the substitution of other recreation properties <br />of at least equal fair market value and of reasonably equivalent usefulness <br />and location." <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and <br />unanimously carried, the meeting was adjourned. <br /> <br />Clerk to the Board <br /> <br /> <br />
