<br />Campaign in September. It was understood that individuals and companies
<br />bringing tires to the landfill for cutting would be responsible for paying
<br />for the cutting of their tires at that time.
<br /> Mr. William E. Fisher, Owner of J & F Disposal Company, Inc.; Mr.
<br />Hubert E. Hoglen, Jr., Owner of Royal Garbage Service; and Mr. Eric Black,
<br />District Manager of Browning-Ferris Industries of South Atlantic, Inc., were
<br />present to request an increase in residential service rates from $7.50 per
<br />month to $25.00 per quarter effective January 1, 1985. They stated this
<br />rate increase was necessary due to the user fee imposed on the refuse
<br />haulers at the Cabarrus County Landfill beginning on October 1, 1984.
<br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt
<br />with Commissioners Payne, Barnhardt, and Milloway voting for and Commissioner
<br />Nash and Chairman Lentz voting against, the Board denied the residential
<br />rate increase requested by the franchised refuse haulers at this time.
<br /> Commissioner Payne stated that he would recommend to the Health Board
<br />that an investigation be made into the possibility of bidding garbage
<br />collection service in Cabarrus County.
<br /> The Board reviewed the request from Ms. Alice H. Hedt, Regional
<br />Ombudsman with the Centralina Council of Governments, that the Cabarrus
<br />County Domiciliary Home Community Advisory Committee be increased by one
<br />member and that a new committee member be appointed to fill the position
<br />presently held by Ms. Vickie Waddell. According to Ms. Hedt, Ms. Waddell
<br />has not attended any of the committee meetin~ or required visits since
<br />her appointment in January, 1984.
<br /> Commissioner Milloway nominated Mrs. Frances B. Long for appointment
<br />to the Domiciliary Home Community Advisory Committee.
<br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt
<br />and unanimously carried, the Board closed nominations for the Domiciliary
<br />Home Community Advisory Committee.
<br /> The Board appointed Mrs. Frances B. Long to the Domiciliary Home
<br />Community Advisory Committee for a term ending December 21, 1985.
<br /> After discussion regarding the position held by Ms. Vickie Waddell,
<br />the Board indicated that they wished to follow the procedures adopted by
<br />the Board of Commissioners whereby a member of a committee would be replaced
<br />for failure to attend at least 75 percent of committee meetings. It was
<br />noted that Ms. Waddell was recommended for appointment by the domiciliary
<br />home administrators and letters are to be written to the administrators
<br />requesting that they submit another name for appointment to that position.
<br /> The Board again discussed the appointment to the Cabarrus County Planning
<br />Board. Commissioner Nash proposed that the membership on the Planning Board
<br />be increased from five to seven members and that the previous nominees--
<br />Messrs. R. M. Faggart, Jr., John Coble, and Robert L. Quesenberry, Jr.--
<br />be appointed to the Planning Board.
<br /> The Board received the letters from Mr. Alvie L. Isenhour, President
<br />of the Cabarrus County Home Builders Association, recommending Messrs.
<br />GeneS. Holbrooks and R. M. Faggart, Jr., for appointment to the Cabarrus
<br />County Planning Board.
<br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne with
<br /> Commissioners Payne and Nash and Chairman Lentz voting for and Commissioners
<br /> Barnhardt and Milloway voting against, the Board approved on first reading
<br /> the increase of the Cabarrus County Planning Board to a seven person board.
<br /> Mr. John R. Boger, Jr., County Attorne~ announced that Mr. James
<br /> Rutledge had resigned from the Cabarrus County Industrial Facilities and
<br /> Pollution Control Financing Authority effective September 1, 1984. An
<br /> appointment is to be made to this Authority at the next Board meeting.
<br /> Mr. John R. Boger, Jr., County Attorney, reported that a lawsuit had
<br /> been filed on July 27, 1984, in United States District Court by Chris Roger
<br /> Harrell against Kannapolis Police Officers R. A. Caskey and S. A. May,
<br /> former Chief of Police R. L. Ketchie, the Cabarrus County Sheriff's Department,
<br /> and Cabarrus County for an alleged incident that occurred on July 27, 1981.
<br /> According to Mr. Boger, the complainant alleged false arrest, false imprison-
<br /> ment, and intentional infliction of emotional distress by the officers.
<br /> Mr. Boger further stated that the County does not have liability coverage
<br /> to cover the lawsuit as the County had liability insurance on a claims made
<br /> basis at the time of the incident. In conclusion, he recommended that the
<br /> officers named in the lawsuit be awarded a defense by Cabarrus County.
