548 <br /> <br />Mr. John Motley stated that a package waste treatment plant to service <br />the mobile home park would probably overrun the stream located on the property. <br /> The detailed findings and compatibility with other ordinances and <br />resolutions as submitted by the Planning staff were as follows. <br /> <br />(1) Not consistent with current land use plan. <br />(2) Not consistent with land development plan. <br />(3) No public facilities to support density. <br />(4) Spot Zoning <br />(5) Single-family use could result in 800 units. <br /> <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne <br />and unanimously carried, the Board denied Petition 86-27 by Charles Stephen <br />Myers to rezone property off Odell School Road from ARR to R-7.2. <br /> <br />ZONING TEXT AMENDMENT <br /> <br />Section 5.23~ Page 83 - Add to end of Section 5.23 - This Section will <br />apply to all existing and newly proposed swimming pools. This amendment <br />was tabled at the September Commissioners' meeting. <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board removed the proposed Zoning Text Amendment <br />from the table for consideration. <br /> Mr. Thomas B. Robinson, Planning Director, reported that the Zoning <br />Administrator had requested this amendment to permit uniform enforcement of <br />the provisions of the Zoning Ordinance. Stating that permits for swimming <br />pools are not always obtained from the Building Inspection Department, Mr. <br />Robinson explained that it is often difficult for the Zoning Administrator to <br />determine newly installed pools from the pools that were in place prior to <br />the adoption of the Zoning Ordinance. <br /> Mr. F. A. Rankin, Jr., opposed the proposed amendment, stating that the <br />zoning regulations should not be made retroactive to include all pools in the <br />county. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board denied the proposed amendment to Section <br />5.23, Page 83 of the Zoning Ordinance. <br /> Chairman Lentz asked Mr. Robinson to look into the possibility of <br />sending a letter to swimming pool contractors in the area to notify them of <br />the need to obtain a permit from the Building Inspection Department prior to <br />installing a swimming pool in the county. <br /> <br />MINIMUM HOUSING CODE TEXT AMENDMENT <br /> <br />(1) Section XIV~ Pase 13 - Amend <br /> <br />From: (a) Preliminary InvestiKation; Notice; HearinR. ~rhenever a <br /> petition is filed with the Inspector by a Public Authority or <br /> by at least five (5) residents of Cabarrus County .... <br /> <br />To: <br /> <br />(a) Preliminary InvestiKation; Notice; HearinR. Whenever a <br /> verified petition is filed with the Inspector by a Public <br /> Authority or by at least five (5) residents of Cabarrus <br /> County... <br /> <br />This amendment was tabled at the September Commissioners meeting. <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board removed the proposed Minimum Housing Code <br />amendment from the table for consideration. <br /> There was no one present to speak either for or against the proposed <br />amendment. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board amended Section XIV, Page 13 of the Minimum <br />Housing Code to read as follows: <br /> <br />(a) <br /> <br />Preliminary InvestiKation; Notice; Hearing.
