<br />PURPOSE OF BUDGET REVISION REQUEST:
<br /> Budget amendment needed to appropriate funds as needed for jail
<br /> construction.

<br /> UPON MOTION of Commissioner Hamby, seconded by Chairman Lentz and unani-
<br />mously carried, the Board adopted the following Resolution Authorizing Condem-
<br />nation to Acquire Certain Property for Extension of Landfill Operations and
<br />appropriated $4,000.00 from the Contingency Fund for these condemnation
<br />purposes.

<br />RESOLUTION AUTHORIZING CONDEMNATION
<br /> TO ACQUIRE CERTAIN PROPERTY FOR
<br /> EXTENSION OF LANDFILL OPERATIONS
<br />
<br /> W~EREAS, the Board of Commissioners of the County of Cabarrus hereby
<br />determines that it is necessary and in the public interest to acquire certain
<br />property owned by Junior Lee Goodman and wife Virginia Ann Goodman for the
<br />following public purpose:
<br />
<br />To protect the public health, to provide the public with an
<br />adequate and sound system for the disposal of solid waste, and to
<br />improve such system to meet the need for expanded or upgraded
<br />services, the plaintiff is condemning the property described herein
<br />for public solid waste disposal purposes, specifically to extend and
<br />improve the sanitary landfill, and thereby to continue to provide a
<br />safe method and location for the disposal of solid waste for the
<br />residents of Cabarrus County.
<br />
<br /> WHEREAS, the proper officials or representatives of the County of
<br />Cabarrus have been unable to acquire the needed interest in this property by
<br />negotiated conveyance.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
<br />COUNTY OF CABARRUS, THAT:
<br />
<br /> 1. Cabarrus County shall acquire by condemnation, for the purposes
<br />stated above, a fee simple interest in and to the property described as
<br />follows:
<br />
<br /> Lying and being in No. 5 Township, Cabarrus County, North
<br />Carolina, adjoining Cabarrus County, Blanche B. Patterson, and
<br />Junior Lee Goodman, and more particularly described as follows:
<br />
<br /> BEGINNING at an existing iron pipe, an existing corner of
<br />Goodman and Cabarrus County (set iron pipe being S. 83-19-19 W.,
<br />2,831.02 feet from North Carolina geodetic survey monument "Silas");
<br />thence with Cabarrus County, S. 24-58-25 W., 150.20 feet to a set
<br />iron pipe, a new corner of Cabarrus County and Goodman; thence a new
<br />line with Goodman, N. 67-57-03 W., 1,474.20 feet to a set iron pipe
<br />in Patterson's line, a new corner of Goodman; thence with Patterson,
<br />N. 09-32-27 W., 176.09 feet to an existing iron pipe, a corner of
<br />Patterson, and an old corner of Cabarrus County; thence with an old
<br />
