248 <br /> <br />misdemeanor and shall be punishable by a fine not to exceed Fifty Dollars <br />($50.00) or imprisonment not to exceed thirty (30) days as provided by G.S. <br />153-A-123. Any person who violates any regulation adopted by the Board of <br />Health hereunder shall be guilty of a misdemeanor and shall be punishable by a <br />fine not to exceed Fifty Dollars ($50.00) or imprisonment not to exceed thirty <br />(30) days as provided by N.C.G.S. Section 130-203. <br /> <br />The County Commissioners or the Health Director may bring a proceeding in the <br />Superior Court for Cabarrus County for the abatement of any violation of this <br />ordinance and regulations issued pursuant to the authority of this ordinance. <br /> <br />SECTION XVII - SEVERABILITY <br /> <br />If any provision or clause of these regulations with application thereof to <br />any person or circumstances, is held invalid, such a declaration shall not <br />invalidate or affect any other provision or ciause of these regulations, or <br />the application of such provision to other persons or circumstance. <br /> <br />SECTION XVIII - CONFLICT <br /> <br />Ail enactments or portions of enactments in conflict with this ordinance are <br />repealed only to the extent necessary to give these regulations full force and <br />effect. This ordinance shall not operate to repeal regulations relating to <br />solid waste management previously adopted by the Board of Health. <br /> <br />SECTION XIX - EFFECTIVE DATE <br /> <br />These rules and regulations shall be in full force and effective from and <br />after the 1st day of January, 1988. <br /> <br />ATTEST: <br />/s/ Frankie F. Lentz <br /> <br />Chairman <br /> <br /> APPENDIX A <br />FRANCHISE AREAS FOR CABA1LRUS COUNTY <br /> <br />Exclusive franchises to collect solid waste from individual residences in <br />Cabarrus County are hereby granted to the following persons in the following <br />areas of Cabarrus County: <br /> <br />The following portion of Cabarrus County is granted unto Royal Service <br />Company: <br /> Said franchise is granted within the following boundaries: <br />BEGINNING at the center of Old Concord-Salisbury Road and the <br />Rowan-Cabarrus County line and running thence with said Road in a <br />Southerly direction to Brantley Road; thence down the center of Brantley <br />Road in a Westerly direction to 1-85; thence Southwest with 1-85 to the <br />Concord City Limits; thence West with the Concord City Limits to the <br />Southern Railroad tracks; then North with the Southern Railroad tracks to <br />Rogers Lake Road or where Rogers Lake Road extended Westward would cross <br />said tracks; thence West with Rogers Lake Road to Buffalo Creek; thence <br />with Buffalo Creek South 300 feet; thence Northwesterly a line 300 feet <br />Southwest of and parallel with Rogers Lake Road to the Boy Scout Camp <br />Road; thence 300 feet South of the Mooresville Road in a Westerly <br />direction to the Township 3 and Township 4 line; thence with the Township <br />line North to Rowan County; thence with the Rowan-Cabarrus County line in <br />an Easterly direction to the BEGINNING. <br /> <br />The following portion of Cabarrus County is granted unto Browning-Ferris <br />Industries: <br /> Said franchise is granted within the following boundaries: <br />BEGINNING at the intersection of Highway 601 and city limits of Concord <br />at Union Street South and runs thence down the center of Highway 601 in a <br />Southerly direction to the Cabarrus-Union County line, thence east <br />following the county line to the Stanly-Union-Cabarrus county lines, <br />thence North along the Cabarrus-Stanly county line to Rowan cQunty line, <br /> <br /> <br />
