Planning and Zoning Commission Minutes <br />December 16, 1993 ~ <br /> <br />Page 6 <br /> <br />The Chair introduced the fourth item on the Agenda, Petition 93-11' <br /> <br />Applicant: Sherrill Laney, Petitioner/Helms & Overcash, Owners <br />Request: Rez0ning of Property from R-40 to ARR (SU) <br /> <br />This was a request to the Cabarms County Planning and Zoning Commission <br />from Sherrill Laney, Petitioner/Helms & Overcash, Owners, PIN 5603-15-2342, <br />04-9522, to have their property rezoned from R-40 to ARR (SU), to permit a <br />private, non-commercial, recreational use airport, agricultural uses, and single- <br />family detached homes. <br /> <br />The Chair stated that in planning board functions, they serve in an advisory <br />capacity to the Cabarrus County Board of Commissioners. The board will not <br />have any sworn testimony, but we will have a public hearing where we will <br />evaluate the proposal and allow any one who is interested to speak for or against <br />this petition. The Board of Commissioners makes the final decisions on all <br />rezoning requests. They will hear this petition on Tuesday, January 18, 1994, <br />at 7:00 p.m. in the Commissioners Chamber. The Chair then opened the public <br />hearing on Petition 93-11. <br /> <br />Mr. Jonathan Marshall, Staff Member, addressed the Board presenting Petition <br />93-11, staff analysis, video tape, and slides of the airstrip. Mr. Marshall stated <br />to the board that they have received in their packet a number of statements signed <br />by the surrounding property owners. Mr. Marshall presented a letter from the <br />petitioner to the board from Caremoor Retirement Center. <br /> <br />The Chair then read the letter to the board. It read "To Whom It May Concern: <br />I/We have no objection to the rezoning of the Helms/Overcash Property on the <br />west side of Boy Scout Camp Road at 5225 Boy Scout Camp Road to ARR (SU) <br />to include special use as a private, non-commercial, recreational use airport." <br />Signed Tommy Kincaid, Caremoor Retirement Center. <br /> <br />Mr. Marshall said the staff has recommended three conditions to limit the use of <br />the airstrip and with some modification the petitioner has agreed to them. The <br />modified conditions are: <br /> <br />le <br /> <br />The airstrip use will be limited to no more than 5 <br />separate ultralights (as defined by the FAA), <br /> <br /> <br />
