Planning and Zoning Commission <br />March 19, 1992 <br /> <br />Page 9 <br /> <br />inability to use the land in question for any use in <br />conformity with the provision of this ordinance and <br />include substantially more than mere inconvenience and <br />inability to attain a higher financial return. She said <br />she believes that there are uses the owner could have in <br />conformity with this ordinance other than this one. It <br />might not be building a garage for an RV vehicle. So <br />that is the one she has not found any evidence to <br />support. Three, the variance, if allowed, will not <br />substantially interfere with or injure the rights of <br />others whose property would be affected by allowance of <br />the variance. She knows that there are two affidavits by <br />neighbors and she would suspect that that will begin at <br />least to comply with that. Although those neighbors will <br />not always be there, she would also note the general <br />character of the neighborhood is quite dense. Four, The <br />variance is in harmony with and serves the general intent <br />and purpose of this ordinance and the adopted <br />Comprehensive Plan or-portion thereof. This is clearly <br />a residential neighborhood and the spirit of the <br />ordinance is to keep it residential and to preserve some <br />kind of aesthetic quality. She did not find any <br />particular objection to having a garage in part of a <br />residential neighborhood. No evidence other than the <br />photographs received by the board. Five, the variance <br />will result in substantial justice being done, <br />considering both the public benefits intended to be <br />secured by this ordinance and the individual hardships <br />that will be suffered by a failure of the board to grant <br />a variance. <br /> <br />Mr. Hurlocker said the board can look at the hardship to <br />the individual and choose not to grant it, he has seen <br />pictures and etc. of this piece of property. He would <br />feel that Mr. Trammell could say his interest is in <br />protecting his investment in the particular recreational <br />vehicle. <br /> <br />Mr. Alexander stated the use that is referred to in <br />statement five generally refers to the various types of <br />uses. Some uses may extend a higher financial return. <br />However, in this case, you are talking about residential <br />uses only. <br /> <br />Chairperson Randall stated the board has not addressed <br />the height issue. But it seems to her that there is no <br />way that you can build. If you are going to build a <br />garage for this purpose, that it could be any lower. <br /> <br /> <br />
