Planning and Zoning Commission <br />March 19, 1992 <br /> <br />Page 10 <br /> <br />As there appeared to be no further comments, Mr. Newton <br />said he would like to remind the board in serving as a <br />Board of Adjustment that it requires a 80% vote which <br />means 8 out of 9 would have to be affirmable for the <br />motion to pass. <br /> <br />There being no further comments, Mr. Hurlocker MOTIONED <br />to approve the variance request 0105(V) by Mr. RObert <br />Trammell as submitted with the findings that the board <br />has previously addressed, seconded by Mr. Allison. The <br />vote was 7-2; Mr. Hurlocker, Mr. Allison, Mr. Smith, Mr. <br />Olio-Mills, Ms. stafford, Mr. Huie and Chairperson <br />Randall For; Mr. Hartgen and Mr. Amos Against. The <br />variance request was denied. [This item was reconsidered <br />later in the meeting. See page 16] <br /> <br />Chairperson Randall introduced the fifth item on the Agenda, <br />Conditional Use Application 0169(C). <br /> <br />5. Applicant: Mr. Tommy Johnson <br /> Request: Conditional Use Application 0169(C) <br /> <br />This was a request to the Cabarrus County Planning and <br />Zoning Commission from Mr. Tommy Johnson, P.O. Box 291, <br />Stowe Lane, Harrisburg, N.C. 28075 for a conditional use <br />permit to construct and operate an automobile repair <br />garage (truck repair) . <br /> <br />Chairperson Randall stated this a different kind of <br />petition. On a conditional use, evidence needs to be <br />presented on each condition that is mentioned in the <br />application form. It is not a change from the ordinance, <br />it is a conditional use permitted within the ordinance <br />once conditions have been shown to have been met. <br /> <br />Chairperson Randall then swore in Mr. Michael Downs, <br />Zoning Administrator and Mr. Tommy Johnson, Petitioner. <br /> <br />Mr. Downs, Zoning Administrator, addressed the board <br />presenting, Conditional Use Application 0169(C). Mr. <br />Downs said the location will front on Stowe Lane which is <br />a state maintained road, however, the entrance to Stowe <br />Lane is a little bit pass the state maintenance. It is <br />the staff's recommendation that the applicant continue to <br />pave the road up to the entrance to the machine shop <br />area. Mr. Downs presented as evidence to the bOard <br />Exhibit "A" Site Plan, Exhibit "B" Septic Tank System, <br />Exhibit "C" Affidavits and Exhibit "D" a Video Tape. <br /> <br /> <br />
