295 UPON MOTION of Commissioner Hamby, seconded by Commissioner Carpenter with Commissioners Hamby and Carpenter and Vice-Chairman Barnhart voting for, the Board adopted the following Proclamation. HUNTING AND FISHING DAY PROCLAMATION WHEREAS, hunting and fishing have always been an important part of the American tradition; and WHEREAS, for over 100 years, hunters and anglers have been in the forefront of the conservation movement, providing the impetus and the financing for many of the wildlife conservation programs existing today; and WHEREAS, these programs have resulted in the dramatic comeback of many species such as woodchucks, whitetailed deer, trumpeter swan, wild turkey, elk and pronghorn antelope; and WHEREAS, as individuals, and through their organizations, sportsmen and women volunteer countless hours of their time for conservation projects and to educate others about the wise management of our natural resources; and WHEREAS, we commend the ethical hunters and anglers of Cabarrus County for their unselfish dedication and contributions to conservation; and WHEREAS, to date sportsmen and women have provided more than $12 billion nationally for conservation programs that benefit all species of fish and wildlife, chipmunks and song birds as well as deer and elk. NOW, THEREFORE, BE IT RESOLVED that the Cabarrus County Board of Commissioners does hereby join with President George Bush, the Congress of the United States, and Governor James Martin in declaring September 28, 1991 as National Hunting and Fishing Day and call upon all citizens of Cabarrus County to join with sportsmen-conservationists in their efforts to ensure the wise use and proper management of our natural resources to benefit future generations. Simmons, Jr., Chairman NEW BUSINESS Ms. Annette Cash, resident of the Mulberry Road Community, presented a "Petition Against Montgomery Tank Lines" in which she related concerns regarding the evacuation of her community on August 17, 1991 and the emission of chemical fumes by Montgomery Tank Company. She cited such concerns as the effect of the chemical ethyl acrylate on the residents, the lack of an exit from the community other than directly past the company, the need for a division in Cabarrus County trained in the handling of hazardous materials, the lack of posted information on the facility listing the type of chemicals used by the company, and alleged violations of the Cabarrus County Zoning Ordinance. In conclusion, she asked to have the company closed and expressed fear for the lives of the residents, children, animals, water and land. Mr. Ben Mabrey, Director of Emergency Management, updated the Board on the Mulberry Road/Montgomery Tank Company situation. He explained that the lack of posted information regarding the use of chemicals had necessitated the call to the Charlotte HazMat team for assistance in the identification and containment of the ethyl acrylate which he described as a mild irritant. Mr. Mabrey reported that the officials from the Environmental Protection Agency had visited the site and had agreed to issue a summons to the company if Mr. Mabrey determines there is an odor problem in the future. Also, he reported that company officials had on this date stated they would no longer use ethyl acrylate to wash their tanks. Mr. Mabrey further advised the Board that a needs assessment is being done in cooperation with the City of Concord to determine if a more advanced level of hazardous materials response team is needed in Cabarrus County. In conclusion, he reported that the company is basically safe in its operation but stated he would continue to closely monitor the situation. Dr. William F. Pilkington, Health Director, reported that the Health Department was performing water samples for homes in that area and thus far all wells tested had been free of chemicals.
