412 <br /> <br />(1) <br /> <br />Petition 91-11. Agnes Knight, petitioner for Kenneth Knight. <br />PIN 5509-16-3069, off Pitts School Road behind Pitts Fire <br />Dept. Wish to rezone from R-40 to C-3. Planning and Zoning <br />Commission voted 8-'0 to recommend denial of this petition. <br /> <br /> Mr. Marshall reported that staff had recommended denial of the petition <br />because the private drive was not adequate, the use did not meet the C-3 intent, <br />sewer was not available, the property did not serve as general business section, <br />and the building did not comply with the State Building Code. <br /> Chairman Carpenter opened the public hearing for Pet£tion 91-11. There <br />was no one present to speak either for or against the proposed rezoning, and the <br />public hearing was closed. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne with <br />Commissioners Hamby, PaYne, and Barnhart and Chairman Carpenter voting for, the <br />Board denied Petition 91-11 by Agnes Knight to rezone property off.Pitts School <br />Road, PIN 5509-16-3069, from R-40 to C-3. <br /> Commissioner Payne asked that the Department of Planning, Zoning, and <br />Building Inspections to take steps to see that the violations are corrected. <br /> <br />Small Area Plan Adoption <br /> (1) The Midland Area Plan is presented for review and possible <br /> adoption as a policy guide. The Planning and Zoning Commission <br /> voted 8-0 to recommend approval of this plan with the following <br /> clarifications and amendments: <br /> <br />1. Ail recommendations citing the inclusion of the School <br />Facilities Study recommendations into this plan should <br />reference Board of Education Facility recommendations instead. <br /> <br />2. Utility recommendations should emphasize the pursuit of <br />a regional waste treatment and collection system with <br />consideration of a system entirely within Cabarrus County only <br />if the regional option is not feasible. <br /> <br /> Commissioner Barnhart reported that residents of the area had commended <br />the Planning staff for its professionalism in preparing the proposed small area <br />plan. Also, he asked staff to pursue the possibility of the Reed Mine being <br />considered as a regional park. <br /> Chairman Carpenter opened the public hearing for the Midland Small Area <br />Plan. There was no one present to speak either for or against the proposed <br />plan, and the public hearing was closed. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Payne with <br />Commissioners Barnhart, Payne and Hamby and Chairman Carpenter voting for, the <br />Board approved the Midland Area Plan as recommended with the following <br />clarifications and amendments by the Planning and Zoning Commission. <br /> <br />1. All recommendations citing the inclusion of the School <br />Facilities Study recommendations into this plan should <br />reference Board of Education Facility recommendations instead. <br /> <br />2. Utility recommendations should emphasize the pursuit of <br />a regional waste treatment and collection system with <br />consideration of a system entirely within Cabarrus County only <br />if the regional option is not feasible. <br /> <br />The Midland Area Plan study area included the whole of Township 10 and that <br />portion of Townships 9 and 11 east of U.S. 601 and south of N. C. 200. The <br />exact area plan boundary was Flowes Store Road to the west, the Rocky River, U. <br />S. 601 and N.C. 200 to the north, the Stanly County line to the east and the <br />Union and Mecklenburg County line to the south and east. The Plan as adopted <br />is on file in the Office of County Manager. <br /> <br />Amendment to "Ordinance for Issuing Permits and Prescribing Fees for Permits <br />and Inspections for Cabarrus County. <br /> <br />Proposed amendment to read: <br />No applicant may obtain a permit of any kind without correcting all <br />code defects in his/her work performed under a previously issued <br />permit. <br /> <br /> <br />
