362 <br /> <br />forth the responsibilities and working arrangements for maintaining <br />a continuing, comprehensive, and cooperative transportation planning <br />process; <br /> NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF <br />THE COUNTY OF CABARRUS, NORTH CAROLINA, <br /> That the Memorandum of Understanding between the City of <br />Kannapolis, City of Concord, Town of China Grove, Town of Landis, <br />Town of Harrisburg, Cabarrus County, Rowan County, and North <br />Carolina Department of Transportation, AGREEMENT NO. 2-01-95, be <br />approved and that the Chairman of the Board of Commissioners and the <br />Clerk of Cabarrus County are hereby directed to execute the <br />Memorandum of Understanding. <br /> <br />Recommended Changes by the Parks and Recreation Commission in the State's <br />Regulations for Limited Food Service Establishments <br /> <br /> Dr. William F. Pilkington, Health Director, and Mr. Steve Little, Parks and <br />Recreation Director, reviewed the new Limited Food Service Establishment <br />requirements and their impact on volunteer athletic leagues and public park <br />concession operations. Specifically, the requirement that prohibits the <br />operation of these establishments beyond 60 days per year will be difficult to <br />meet since many concession stands are shared by two or more non-profit groups <br />during the year. In addition, most concession stands are open only during <br />evenings and weekends, thus requiring inspections by public health staff outside <br />regular business hours. The Parks and Recreation Commission voted at its meeting <br />on March 2 to request the Board to seek changes in the present regulations for <br />Limited Food Service Establishments. <br /> <br /> UPON MOTION of Chairman Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board approved the recommendations for the following <br />changes to the Limited Food Service Establishments regulations as submitted by <br />the Parks and Recreation Commission and voted to send copies of these recommended <br />changes to the local legislative delegation as well as to other boards of county <br />commissioners across the state. <br /> <br />(1) <br /> <br />(2) <br /> <br />Limited Food Establishment Law should have less restrictive <br />guidelines. <br />Recommended to change the Regulations for a Limited Food <br />Establishment for any facilities who serve more than 120 days <br />per year instead of the present 60 days. <br /> <br />Request to Waive Hiring Freeze for Specific Vacant Positions <br /> <br /> Mr. Don Moorhead, Personnel Officer, presented the request to waive the <br />hiring freeze for the following two positions: (1) Sheriff Department (Jail) - <br />Food Service Supervisor; and (2) Health Department Public Health Nurse II <br />(School Health Nurse). <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Niblock and <br />unanimously carried, the Board agreed to waive the hiring freeze for the <br />following position: Sheriff Department (Jail) - Food Service Supervisor (21-310- <br />101-24). <br /> <br /> Motion was made by Commissioner Fennel and seconded by Commissioner Olio- <br />Mills to delay the School Health Nurse (PHN II) position until the fall. After <br />discussion by Board members and Dr. Pilkington regarding the need to fill the <br />position at this time, the motion and second were withdrawn. <br /> <br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Fennel and <br />unanimously carried, the Board agreed to waive the hiring freeze for the <br />following position: Health Department Public Health Nurse II (School Health <br />Nurse) (58-40-102-1). <br /> <br /> Commissioner Olio-Mills expressed concern that no positions have been <br />eliminated. Chairman Barnhart commented that the Performance Audit is currently <br />in progress and will help to determine the appropriate number of workers for <br />County functions. <br /> <br /> <br />
