<br /> WHEREAS, the Board of CountyCommissioners of Cabarrus County,
<br />the Board of County Commissioners of Stanly County, and the Board
<br />of County Commissioners of Union County by Joint Resolution dated
<br />March 31, 1981, modified their Joint Resolution dated April 1, 1974,
<br />by renaming the area program "Piedmont Area Mental Health, Mental
<br />Retardation, and Substance Abuse Authority"; and
<br />
<br /> WHEREAS, the Board of County Commissioners of Rowan County
<br />have by resolution unanimously adopted in May, 1997, requested to
<br />join Piedmont Area Mental Health, Mental Retardation and Substance
<br />Abuse Authority; and
<br />
<br /> WHEREAS, the Commission for Mental Health, Developmental
<br />Disabilities, and Substance Abuse Services has in July, 1997
<br />designated Cabarrus, Rowan, Stanly and Union Counties as a catchment
<br />area for the provision of mental health, developmental disabilities,
<br />and substance abuse services pursuant to G.S. 122C-115(c); and
<br />
<br /> WHEREAS, the County Commissioners for Cabarrus, Rowan, Stanly
<br />and Union Counties believe that it would be in the best interest of
<br />the citizens of their respective counties to include Rowan County
<br />within Piedmont Are Mental Health, Developmental Disabilities, and
<br />Substance Abuse Authority;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED JOINTLY BY THE BOARDS OF COUNTY
<br />COMMISSIONERS OF CABARRUS COUNTY, ROWAN COUNTY, STANLY COUNTY, AND
<br />UNION COUNTY that the Joint Resolution of the Boards of County
<br />Commissioners of Cabarrus, Stanly and Union Counties dated April 1,
<br />1974, as amended by the Joint Resolution of the Boards of County
<br />Commissioners of Cabarrus, Stanly and Union Counties dated March 31,
<br />1981, be amended and restated as follows:

<br /> Section 1. Effect on Prior Resolutions
<br /> This resolution is intended to amend and restate the Joint
<br />Resolution of the Boards of County Commissioners of Cabarrus, Stanly
<br />and Union Counties dated April 1, 1974, as amended by the Joint
<br />Resolution of the Boards of County Commissioners of Cabarrus, Stanly
<br />and Union Counties dated March 31, 1981.
<br />
<br /> Section 2. Establishment of Piedmont Area Mental Health,
<br />Developmental Disabilities and Substance Abuse Authority.
<br />
<br /> There is hereby created and established pursuant to G.S.
<br />Chapter 122C-115 ( c ) an area mental health, mental retardation,
<br />and substance abuse authority known as Piedmont Area Mental Health,
<br />Developmental Disabilities and Substance Abuse Authority
<br />(hereinafter sometimes referred to as "Piedmont Area Authority") to
<br />provide mental health, developmental disabilities, and substance
<br />abuse services in Cabarrus County, Rowan County, Stanly County, and
<br />Union County.
<br />
<br /> Section 3. Status and Powers and Duties of Piedmont Area
<br />Mental Health, Developmental Disabilities, and Substance Abuse
<br />Authority.
<br /> Piedmont Area Authority shall be a local political subdivision
<br />of the State of North Carolina pursuant to G.S. 122C-116 and shall
<br />have the powers and duties conferred upon it by G.S. 122C-117.
<br />
<br /> Section 4. Structure of Area Board
<br /> The Area Board of Piedmont Area Authority shall meet the
<br />requirements of G.S. 122C-118. The Area Board shall be initially
<br />composed of 19 members with five each from Cabarrus, Stanly and
<br />Union Counties and four from Rowan County. As the terms of the fifth
<br />member from Cabarrus, Stanly and Union Counties expire, no fifth
<br />member from those counties shall be appointed, and the Area Board
<br />shall thereafter be composed of 16 members with four from each
<br />constituent county of the Area Authority.
<br />
<br /> Section 5. Organization of the Area Board
<br /> The Area Board shall elect a Chair and a Vice-Chair and shall
<br />be organized as provided in G.S. 122C-119.
