<br />Approval of Community Based Alternatives Task Force Proqram Recommendations and
<br />Authorization for the Chairman to Siqn the Proqram Aqreements on Behalf of
<br />Cabarrus County

<br /> Ms. Beverly Parker-Reece, Chairperson of the Community Based Alternatives
<br />(CBA) Task Force, reviewed the new Cabarrus County Teen Court and Resolve
<br />Program, which will allow first time offenders of minor misdemeanors to be tried
<br />by their peers. The program will be sponsored by the Cabarrus County Mediation
<br />Center and will require a local cash match of $7,112.00.

<br /> UPON MOTION of Commissioner Niblock, seconded by Commissioner Barnhart and
<br />unanimously carried, the Board approved the following Community Based
<br />Alternatives program agreements and authorized the Chair to sign the appropriate
<br />contracts.

<br />Kannapolis Request for Extraterritorial Jurisdiction - Public Hearinq - 6:30 p.m.

<br /> Mr. Jonathan Marshall, Planning Services Director, introduced the request
<br />by the City of Kannapolis to create extraterritorial jurisdiction (ETJ) over an
<br />area scheduled for annexation on June 30, 1999. He discussed issues relating to
<br />the protection of non-residential areas and the Westside Bypass corridor,
<br />continuation of shared city/county services and the scheduled completion of the
<br />Unified Development Ordinance.

<br /> Mr. David Hales, Kannapolis City Manager, presented the City's request for
<br />the creation of ETJ for Annexation Area I. He stated the granting of ETJ would
<br />allow the City to take an active role in planning for the future of the area,
<br />including land use regulations, road construction and maintenance standards and
<br />identification of future economic development areas. Further, it would help to
<br />avoid confusion or non-conformities resulting from the completion of the Unified
<br />Development Ordinance soon after the annexation. If the request for ETJ is
<br />denied, Mr. Hales asked the County to include the City in the review of any
<br />development proposals for the annexation area that are received during the next
<br />14 months.

<br /> Mr. Richard Flowe, Kannapolis Planning Administrator, presented maps showing
<br />the location of the annexation area and surrounding northeast area. He discussed
<br />the City's interest in maintaining and managing growth, its desire to involve the
<br />area residents in developing a land use plan and the need to accurately plan for
<br />the municipal services that the City will provide to the annexation area.
<br />
<br /> At 7:48 P.M., Chairman Casper opened the public hearing on the request by
<br />the City of Kannapolis to exercise ETJ in the area known as Annexation Area I.
<br />She asked speakers to limit their comments to three minutes or less.
<br />
<br /> Mr. Thomas Barnhardt, resident of the annexation area, opposed the request
<br />for ETJ. He stated the City of Kannapolis has nothing to offer the residents in
<br />that area and has no plans to provide services to the area.
<br />
<br /> Ms. Marilyn Barnhardt, resident of 5800 Wabash Lane located within the
<br />annexation area, objected to the City's request for ETJ as well as to forced
<br />annexation. She opposed any further industrial or commercial zoning in her
<br />community and objected to living within the City of Kannapolis.
<br />
<br /> Mr. David Austin, annexation area landowner, farmer and land developer of
<br />2425 Trinity Church Road, agreed there does need to be good planning when
<br />annexing people and land into a city. However, he stated the annexation area
<br />
