Mr. Hartsell reviewed the legal requirements relating to the lease of County property in excess of ten (10) years. He presented a revised Resolution for the Board's consideration. UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter and unanimously carried, submitted by Mr. Hartsell. NORTHCAROLINA CABARRUS COUNTY the Board adopted the following Resolution as Resolution #1998-35 RESOLUTION AUTHORIZING THE COUNTY MANAGER TO LEASE REAL PROPERTY WHEREAS, Cabarrus County (the "County") owns a 19.57 acre tract of land located west of and adjacent to Corban Avenue (N.C. Hwy. 73) in Concord, North Carolina, more particularly identified as tax PIN #5630-38-5838 (the "Senior Center Property"), upon which is located the Cabarrus County Senior Center (the "Senior Center"); and WHEREAS, the Senior Center is a public facility which houses the Cabarrus County Department of Aging and where the County provides services and activities for the senior population of the County and their families, and which serves as a central meeting facility for the community; and WHEREAS, the L.I.F.E. Center, Inc. (the "L.I.F.E. Center"), is a not-for-profit entity qualified under section 501(c) (3) of the Internal Revenue Code, to which the County is authorized to appropriate funds, and has previously appropriated funds; and WHEREAS, the L.I.F.E. Center carries out a public purpose in providing a wide range of adult day care and related services generally to and for the senior population of the community consistent with and as a complement to services provided by and through the Cabarrus County Department of Aging at the Senior Center; and WHEREAS, pursuant to N.C.G.S. 153A-176, 160A-267, 160A-272 and 160A-279, the County desires to lease to the L.I.F.E. Center for a period in excess of ten (10) years, and the L.I.F.E. Center desires to lease from the County a portion of the Senior Center Property for the purpose of the L.I.F.E. Center's construction thereon of an adult day care facility (the "Lease"); and WHEREAS, the County and the L.I.F.E. Center desire for the Lease to: (a) Include the southwest portion of the Senior Center Property, as more particularly identified in a survey provided to the County by the L.I.F.E. Center; and (b) Identify adequate access across and/or joint use of the Senior Center and the Senior Center Property. IT IS, THEREFORE, RESOLVED that: 1. The County Manager, on behalf of the County, is hereby authorized to execute and enter into the Lease with the L.I.F.E. Center, Inc., for a portion of the Senior Center Property for the sum of $1.00 and other valuable consideration for a term in excess of ten (10) years and in form and content generally consistent with the draft lease attached hereto and incorporated herein by reference. 2. A notice summarizing the contents of this Resolution shall be published once subsequent to its adoption. 3. The Lease shall not be consummated until ten (10) days subsequent to its publication.
