39 <br /> <br /> WHEREAS, Cabarrus County (the "County") owns a 1.851 acre tract of land <br />in the area of the Cabarrus County Landfill adjacent to Mr. and Mrs. Alvin <br />Vance Joyner and Irish Potato Road (the "County Property"); and <br /> WHEREAS, Mr. and Mrs. Alvin Vance Joyner (the "Joyners") own or claim <br />two (2) tracts of land adjoining the Landfill totaling 1.85 acres (the <br />"Joyner property"); and <br /> WHEREAS, the County and the Joyners desire to exchange the County <br />Property described in a Deed, a copy of which attached hereto as Exhibit A <br />for the Joyner Property described in a Deed, a copy of which is attached <br />hereto as Exhibit B (the "Exchange"); and <br /> WHEREAS, the County may exchange real property belonging to the County <br />for other real property by private negotiation if the County receives full <br />and fair consideration in exchange; and <br /> WHEREAS, the County has determined that the Exchange is appropriate, <br />and has advertised its intention to consider a resolution authorizing the <br />Exchange for ten (10) days; and <br /> WHEREAS, no one has objected to the Exchange in advance of the regular <br />meeting of the Board of Commissioners scheduled for 6:30 p.m. on September <br />21, 1998. <br /> NOW, THEREFORE, upon receipt from the Joyners of the Deed for the <br />Joyner Property described in Exhibit B and their payment of the advertising <br />cost relating to the consideration of this Resolution, the Cabarrus County <br />Board of Commissioners hereby resolves to transfer the County Property <br />described in Exhibit A to the Joyners in exchange therefor, and hereby <br />authorizes the Chair to execute the Deed described in Exhibit A to the <br />Joyners therefor. <br /> This the 21st day of September, 1998. <br /> <br />CABARRUS COUNTY <br />By: /$/ Sue B.
