She explained that a potential for financial gain mayor may not have occurred during the selection process and therefore she had not voted. However, Vice Chairman Juba said the vote in December had been to proceed with the contract and she had voted because the award of the project to Turner Construction had already taken place and there was no potential for financial gain. She said there was no reason to recuse herself from voting on the Amendment at this time. Commissioner Carpenter asked that the motion be amended to include the word "tunnel." vice "tunnel." Chairman Juba agreed to amend her motion to include Chairman Carruth agreed with the change in the motion. the word UPON MOTION of Vice Chairman Juba, seconded by Chairman Carruth with Vice Chairman Juba, Chairman Carruth and Commissioner Carpenter voting for and Commissioners Freeman and Privette voting against, the Board of Commissioners approved Amendment #1 to the contract for Construction Manager at Risk for the construction of the Cabarrus County Detention Center and Sheriff's Department between Cabarrus County and Turner Construction Co., which amendment is made pursuant to Article 7 of the Contract to set the guaranteed maximum price for construction of the site work, annex and tunnel, including the estimated cost of work as defined in the contract and the construction manager's fee as therein defined at $14,836,546.00, including the exposure holds totaling $300,000.00, and to set the date of substantial completion for this part of the work as July 18, 2007 and to authorize the County Manager and County Attorney to execute a contract amendment to such effect; and to approve a budget amendment(s) to fund the owner costs and the construction costs as follows: $ 750,200.00 owner costs per budget amendment; and $15,000,000.00 for construction of site work and annex and issuance costs for COPS per budget amendment. The budget amendments as approved by the Board were as follows: BUDGET REVISION/AMENDMENT REQUEST DEPARTMENT OF FINANCE AMOUNT: $750,200.00 TYPE OF ADJUSTMENT: Transfer Between Function/Funds PURPOSE OF REQUEST: A contribution is requested to be made to the Sheriff's Office and Detention Center Construction Fund for Owner Costs that will be incurred during the building of the Annex and the Site work for the property. This will be funded from the COPS Jail Interest amount that will not be used in FY 06 due to delays in financing of the project. The Owner costs will be funded through FY 06 budgeted COPS Jail Debt Service that will not be used in FY 06 due to the delay in financing for the Sheriff's Office and Detention Center Project. The Construction GMP (Guaranteed Maximum Price) contract will be funded through the issuance of COPS that was approved at the 5-15-06 Board of Commissioners meeting.
