May 6, 2013 (Work Session) <br />Page 1522 <br />The N.C. Department of Transportation has requested to purchase a <br />temporary construction easement on the north /northwest side of <br />the Rocky River Elementary School property as part of the double <br />track rail project around Harrisburg. The purchase request is <br />for less than a tenth of an acre. The standard practice of the <br />Board has been to approve a budget amendment that allows the <br />proceeds of the sale to benefit the affected school. This item <br />has been sent to Board of Education staff for their review and <br />approval. <br />Chairman Poole advised of a need for a motion correcting the meeting <br />date as written in the previous motion for the Creation of a Human Services <br />Agency Agenda item. <br />UPON MOTION of Commissioner Measmer, seconded by Commissioner Burrage <br />and unanimously carried, the Board amended the previous motion and scheduled <br />a public hearing for June 17, 2013 for the discussion and consideration of <br />creating a Human Services Agency and other related aspects of that agency as <br />authorized by NCGS 143A- 77(a). <br />County Manager - NCDOT Request for Design /Construction Agreement Letter <br />Jonathan Marshall, Deputy County Manager, advised the Division 10 Staff <br />of the North Carolina Department of Transportation (NCDOT) have requested a <br />letter from the Board of Commissioners requesting a design and construction <br />agreement for the extension of Raging Ridge Road and the construction of a <br />new bridge. After speaking to NCDOT staff this morning, he advised a <br />resolution is being requested and will be made available at the regular <br />meeting for adoption. <br />A brief discussion ensued. <br />Emergency Management - Transfer of Surplus Vehicle to Odell Volunteer Fire <br />and Rescue Department <br />Mike Downs, County Manager, presented the following information <br />relating to the transfer of a surplus vehicle to the Odell Volunteer Fire and <br />Rescue Department: <br />The Odell Volunteer Fire and Rescue Department has requested a <br />surplus vehicle from Cabarrus County for daily operations in <br />providing services to the citizens within the fire district. The <br />vehicle requested for transfer is (1) 2006 Ford Crown Vic, VIN <br />No. 2FAHP71W56X157646. General Services and Finance Departments <br />have both reviewed the request and the attached vehicle is <br />available for surplus transfer to the Odell Volunteer Fire and <br />Rescue Department per NCGS 153A -176, 160A -274 and 160A -280. <br />Finance - Administrative Transfer of Grant Fundings from the General Fund to <br />a Multi -Year Special Revenue Fund, Special Projects Fund <br />Pam Dubois, Deputy County Manager, presented the following information <br />relating to the administrative transfer of grant fundings from the General <br />Fund to a Multi -Year Special Revenue Fund, Special Projects Fund: <br />The second phase of the Porter Farm Grant was inadvertently <br />placed in the General Fund Budget versus the Special Projects <br />Fund. It is requested, for accounting and tracking purposes, to <br />place the second phase with the first phase. <br />Additionally, it is requested to transfer a matching portion of <br />the Clark Creek Grant from the General Fund to the Special <br />Projects Fund, in order to keep associated grant expenditures <br />with the grant for accounting and tracking purposes. <br />Neither request increases the grant funding nor the County's <br />match. <br />Finance - Approve Use of Contingency Funds for Legal Expenses <br />Ann Wilson, Finance Director, advised the county legal bills have <br />exceeded the amended budget. She stated the primary causes of the increased <br />legal fees are due to tax appeals, APFO (Adequate Public Facilities Ordinance) <br />lawsuits and interim legal work for DSS (Department of Social Services). She <br />requested approval of a budget amendment of $135,000.00 to provide funding for <br />estimated legal expenses through June 30, 2013 from the Contingency Fund. She <br />also responded to questions from the Board. <br />
