May 20, 2013 (Regular Meeting) Page 1540 <br />(G -2) Planning and Development - Proposed Text Amendments: TEXT2013- 00001, <br />Amendments to Cabarrus County Zoning Ordinance and TEXT2013- 00002, Amendments <br />to Cabarrus County Subdivision Ordinance - Public Hearing - 6:30 P.M. <br />Susie Morris, Planning and Zoning Manager, requested approval for <br />proposed Text Amendments: TEXT2013- 00001, amendments to the Cabarrus County <br />Zoning Ordinance. She advised the Cabarrus County Planning and Zoning <br />Commission voted 9 -0 at the April 9th meeting to forward the proposed <br />amendments to the Board of Commissioners for final consideration. The Text <br />Amendment Committee also reviewed the proposed changes. <br />The proposed changes are as follows: <br />Chapter 7 - Section 7 -3 Uses Permitted Based on Standards (PBS) - <br />Proposed text changes to Chapter 7, Section 7 -1, 7 -2, and 7 -3, 1, <br />Accessory Dwelling Unit. The proposed language corrects typos and <br />codifies that only one accessory dwelling unit is permitted per <br />parcel. <br />Chapter 8 - Conditional Uses, #21 Reception Facilities - the <br />proposed text changes address access for the facilities from <br />public and private roads and clarify setbacks where waterbodies <br />exist. <br />Chairman Poole opened the public hearing at 6:55 p.m. The Public <br />Hearing Notice was published on May 15, 2013 in The Independent Tribune. The <br />Public Hearing Notice was also posted on the County's website <br />( www.cabarrus county. us ) on May 8 and 15, 2013 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman <br />Poole closed the public hearing. <br />UPON MOTION of Commissioner Measmer, seconded by Commissioner Burrage <br />and unanimously carried, the Board adopted the following ordinance: <br />Ordinance No. 2013 -09 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br />TEXT2013 -00001 <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br />The following Sections shall be DELETED and REPLACED with amended language: <br />• Chapter 7- Performance Based Standards: <br />• Section 7 -1, Introduction <br />• Section 7 -2, How to use this Chapter <br />• Section 7 -3, Uses Permitted Based on Standards (PBS) #1, Accessory <br />Buildings and Accessory Dwelling Unit, Accessory Dwelling Unit <br />The following Section shall be DELETED and REPLACED with amended language: <br />• Chapter 8- Conditional Uses, #21 Reception Facilities <br />REVISE the Table of Contents to correspond to text changes. <br />Adopted this 20 day of May, 2013 by the Cabarrus County Board of <br />Commissioners. <br />/s/ Elizabeth F.
