May 20, 2013 (Regular Meeting) <br />Page 1541 <br />Cabarrus County Subdivision Ordinance, Section 11, Public and <br />Private Roads. The proposed language codifies when existing 45' <br />right -of -ways may be used for access and clarifies that private <br />roads must be built to the public standard. <br />Cabarrus County Subdivision Ordinance, Section 5, Final Plat <br />Requirements. The proposed language adds an optional certificate <br />that may be used for exemption plats and corrects typos in other <br />certificates. <br />Chairman Poole opened the public hearing at 6:57 p.m. The Public <br />Hearing Notice was published on May 15, 2013 in The Independent Tribune. The <br />Public Hearing Notice was also posted on the County's website <br />( www.cabarrus county. us ) on May 8 and 15, 2013 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman <br />Poole closed the public hearing. <br />UPON MOTION of Vice Chairman White, seconded by Commissioner Burrage <br />and unanimously carried, the Board adopted the following ordinance: <br />Ordinance No. 2013 -10 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY SUBDIVISION ORDINANCE <br />TEXT2013 -00002 <br />BE IT ORDAINED that the Cabarrus County Subdivision Ordinance is hereby <br />amended as follows: <br />AMEND Section 5, Final Plat Requirements, C- Certifications <br />Certifications - the following certificates shall be shown on the Final Plat as <br />applicable: <br />1. CERTIFICATE OF OWNERSHIP AND DEDICATION <br />I (We) hereby certify that I am (we are) the owner(s) of the <br />property shown and described hereon and that I (We) hereby adopt <br />this plan of subdivision with my (our) free consent, established <br />minimum building lines, and dedicate all roads, alleys, walks, <br />parks, and other sites to the public use except as noted. Further, <br />I (We) certify the land as shown hereon is within the platting <br />jurisdiction of Cabarrus County. <br />Date Property Owner <br />2.
