5.106-ASSUMPTIONS AND LIMITING CONDITIONS <br /> The Appraiser assumes: <br /> That any legal descriptions furnished are correct. <br /> That the title to the property is good. <br /> That there are no encumbrances or defects of title other than those mentioned in this report. <br /> That the property is free and clear of all liens. <br /> That any plans furnished are correct. <br /> This report is submitted subject to the following limiting conditions: <br /> That no guarantee is made,nor liability for inaccuracies or errors in estimates or opinions <br /> identified in this report as being furnished by others. <br /> That no survey of the property has been made by the appraiser and no liability is assumed on <br /> matters of a legal character affecting the property, such as title defects,overlapping boundaries, <br /> zoning violations,etc. <br /> That the distribution of the total valuation between land and buildings applies only to the existing <br /> program of utilization. The separate valuation for land and buildings must not be used in <br /> conjunction with any other appraisal-and are invalid if so used. <br /> That there are no hidden or unapparent conditions of the property, sub-soil or structure which <br /> render it more or less valuable. The appraiser assumes no responsibility for such conditions,or <br /> for engineering which might be required to discover such factors. <br /> The appraiser will not be responsible for matters of a legal nature that affect either the property <br /> being appraised or the title to it. The appraiser assumes that the title is good and marketable and, <br /> therefore,will not render any opinions about the title.
