Contract, following any such termination and the final payment from the County to the Contractor, <br /> neither party shall have any further obligation under this Contract other than for claims for personal <br /> injuries or property damage as expressly provided in this Contract and arising prior to such termination <br /> date. <br /> 13.2 Termination by Contractor. In the event of a failure by County to perform any material <br /> provision of this Contract, the Contractor shall give written notice of such breach to the County along <br /> with at least thirty (30) days (the "cure period") to correct such breach. Contractor may terminate this <br /> Contract after such cure period if County has not adequately corrected such breach in accordance with <br /> this Contract and Contractor so notifies County in writing of such termination action. At such time, <br /> County shall pay Contractor for all charges and fees for the services performed on or before such <br /> termination date. Thereafter, following any such termination and the final payment from the County to <br /> the Contractor, neither party shall have any further obligation under this Contract other than for claims <br /> for personal injuries or property damage as expressly provided in these terms and arising prior to such <br /> termination date. <br /> 14. CONTRACTOR'S PROPERTY <br /> All bins, containers, trucks and any other equipment that Contractor furnishes under this <br /> Contract shall remain Contractor's property. County shall be liable for all loss or damage to such <br /> equipment at County Facilities(except for normal wear and tear and for loss or damage resulting from <br /> Contractor's handling of the equipment). County Customer shall be liable for all loss or damage to <br /> such equipment at the Customer's homes(except for normal wear and tear and for loss or damage <br /> resulting from Contractor's handling of the equipment). County and Customers shall use the <br /> equipment only for its proper and intended purpose and shall not overload (by weight or volume), <br /> move or alter the equipment. County shall fully reimburse Contractor for any and all claims resulting <br /> from personal injuries or death, or the loss of or damage to property (including the equipment) arising <br /> out of the use, operation or possession of the equipment by the County or the County's, employees, <br /> agents, suppliers, or guests. Customer shall fully reimburse Contractor for any and all claims resulting <br /> from personal injuries or death, or the loss of or damage to property (including the equipment)arising <br /> out of the use, operation or possession of the equipment by the Customer. <br /> 15. NEWLY DEVELOPED AREAS <br /> Contractor will, within thirty(30) days of notification to the County provide Waste Material <br /> and Recyclable Material collection and disposal services of the same frequency and quality required by <br /> the Contract to newly developed areas within the County's current territorial limits. <br /> 16. CONTRACTOR PERSONNEL <br /> The Contractor's employees who normally and regularly come into direct contact with the public shall <br /> bear some means of individual identification such as uniform with name badges, name tags or <br /> identification cards and the company's name. The Contractor shall assure that employees serve the <br /> public in a courteous, helpful and impartial manner. All employees of the Contractor in both field and <br /> office shall refrain from belligerent behavior and/or profanity, to the extent that such behavior <br /> negatively impacts the provision of service to Customers, and others with whom the Contractor and its <br /> employees come into contact, during the performance of the Contract.
