0 rlifft <br />ACTION <br />Duke Energy Income Qualified Weatherization Program <br />Memorandum of Understanding <br />North Carolina Community Action Association MQU # DEC2015 - 0300 <br />This Memorandum of Understanding ( "Memorandum ") is entered into as of March 2, 2015 by and <br />between the North Carolina Community Action Association (hereinafter referred to as "NCCAA ") and <br />Cabarrus County Planning & Development Services (herein referred to as "Service Provider ") for the <br />Duke Energy Income Qualified Weatherization Program (herein referred to as "DEC WX "). NCCAA and <br />the Service Provider are herein collectively referred to as "Parties" and individually as "Party ". <br />WHEREAS, the Parties desire to assist low- income customers with managing their energy costs by <br />making energy efficiency improvements at the customer's residence in the Duke Energy Carolinas <br />territory. DEC WX Funds will be distributed to parties involved in assisting low- income customers with <br />energy efficiency upgrades. <br />WHEREAS, as a result of the foregoing, NCCAA will: <br />1. Provide a data tracking and reporting system; <br />2. Provide program training and guidance; <br />3. Conduct quality control /quality assurance visits; <br />4. Maintain a website for distribution of information including program contacts and complaint <br />resolution process; and <br />5. Reimburse the Service Provider upon completion and invoicing of work completed based on the <br />program approved price list. <br />In recognition of the foregoing, the Service Provider agrees to participate in the distribution of the Duke <br />Energy Income Qualified Weatherization Program Fund, as follows: <br />1. Utilize funds for the benefit of low- income electric customers for: <br />• Weatherization projects; <br />• Heating repair, upgrades and replacement projects; <br />• Refrigerator replacements; and <br />2. Enter all information required on each customer project into the DEC WX Fund tracking and <br />reporting system (herein referred to as LM Captures). <br />3. Maintain accurate and detailed records of the distribution of the Duke Energy Income Qualified <br />Weatherization Program for a minimum of four (4) years; and upon the Service Provider's <br />receipt of funds, maintain records for up to seven (7) years. <br />4. Provide Duke Energy, NCCAA, Lockheed Martin, or their representatives the right to review all <br />records, at any time, pertaining to the distribution of such funds. <br />Attachment number 1 <br />F -9 Page 103 <br />
