STATE OF NORTH CAROLINA <br />SPECIAL OLYMPICS POSITION <br />COUNTY OF CABARRUS FUNDING AGREEMENT <br />This SPECIAL OLYMPICS POSITION FUNDING AGREEMENT ( "the <br />Agreement ") is entered into effective July 1, 2012 by and between CABARRUS <br />COUNTY, (the "County ") the CABARRUS COUNTY SCHOOLS (the "Schools "). <br />The parties have a common interest in assisting the North Carolina Special <br />Olympics, particularly the program existing in Cabarrus County (the "Program "), and have <br />done so in the past. The parties desire to continue their assistance to the Program through this <br />Agreement, which the parties consider a binding legal commitment. <br />AGREEMENT TERMS <br />1. The Program will be administered by the Schools. <br />2. The duration of this Agreement shall be for sixty -three (63) months, beginning <br />July 1, 2012 and ending September 30, 2017. <br />3. Should the Schools or the Cabarrus County Special Olympics Program <br />desire to extend the term of this Agreement beyond September 30, 2017, either must give <br />written notice to the other no later than July 1, 2017 so that the County can consider <br />continued funding for the Program during its budget cycle for fiscal year 2017 -2018. <br />4. The County will provide the Schools with the support necessary to assist in <br />maintaining records for the Program. <br />5. The County will permit the Schools access to certain Program advertising <br />vehicles reasonably available to the County, including providing access to the County <br />governmental access channel (currently Channel 22 on Time Warner Cable). <br />6. The County will reasonably assist the Schools with soliciting the support, <br />both physically and monetarily, of other local governmental agencies (i.e., ARC of <br />Cabarrus Comity, Piedmont Rehabilitation Development Center, the YMCA, the <br />Cabarrus Workshop, Cabarrus County Group Homes, Concord Parks and Recreation <br />Department, and any County departments). <br />7. The County will compensate the Schools for its Agreement services by <br />funding the salary and benefits for one (1) staff member for each of the five (5)_ years of <br />this Agreement. This amount for each year shall be paid in 1/12 allocation monthly for <br />each respective year. However, in the event this Agreement is terminated during a fiscal <br />year by the Schools, the Schools shall promptly reimburse the County for any unused <br />amount on a prorata basis.. <br />8. The County, through its General Services Department, will provide the <br />Schools with setup support for Special Olympics consistent with the past maintenance of <br />the Program. <br />9.
