PART I WATERSHED OVERLAY ZONE <br />Section 4 -3 Application of Zone <br />The provisions of this district shall apply within the areas designated as a "Public Water Supply <br />Watershed" by the North Carolina Environmental Management Commission. The designated <br />areas are established on the map entitled "Watershed Protection Map of Cabarrus County, <br />North Carolina" which is adopted simultaneously with this section. Any and all amendments to <br />this overlay district shall take effect and be in force at the date of enactment by the Cabarrus <br />County Board of Commissioners. <br />Section 4 -4 Requirements for all lots in the Coddle Creek and Dutch Buffalo Watersheds <br />All lots in the following watersheds shall meet the following requirements: <br />WS -II Watershed Areas: <br />Coddle Creek: WS -II Critical Area and WS -II Balance of Watershed Protected Area <br />2. Dutch Buffalo Creek: WS -II Critical Area and WS -II Balance of Watershed Protected Area <br />1. All lots within the drainage basin's critical area, that is land within 1/2 mile of the high <br />water mark or the ridge line of the watershed (whichever comes first) for the reservoirs, <br />shall have a minimum of two (2) acres. If an der open space development is <br />approved, the density for the site shall remain one dwelling per two (2) acres for <br />development. <br />2. All lots (eF dwelliRg u Rits ^'„ -s+,,. develepmeRts) in the balance of the <br />watershed ^{+"^ diraii^^^^ bass, protected area, {^"+"^ -s shall <br />have a minimum square footage of one acre, or one dwelling unit per acre, or meet <br />requirements of the Coborrus County Zoning Ordinance, whichever is more stringent. <br />Section 4 -5 Additional requirements t-e property voithiR the drainage basin located in <br />a WS -II Critical Area (within 1/2 mile of the high water mark for reservoirs) <br />1. No commercial or industrial development shall be permitted. A 150 -foot vegetative <br />buffer shall be maintained from the normal pool level on all property adjoining the <br />reservoir. No permanent structures shall be allowed within this buffer area. <br />2. Waterbody buffers shall be established as detailed in the Waterbody Buffer Zone <br />section of this Ordinance. <br />3. All non - single family residential and nonresidential development of lots within the <br />critical area shall have an impermeable area of less than six percent (6%). <br />Attachment number 2 \n <br />G -4 Page 339 <br />
