1. Vacant lots Platted but non - developed lots of record may be used even if undersized, <br />and to the extent possible, combined or reconfigured to create one or more lots that <br />meet the standards of the Ordinance. <br />2. Occupied lots Platted and developed lots of record are grandfathered lots. Any <br />additions or new development on these lots shall comply with the density /build -upon <br />standards. The existing non - developed land area of the lot shall constitute the base <br />from which the new development standard is determined. <br />Section 4 -7 Appeal <br />As with all enforcement and administration, decisions of the Zoning Administrator may be <br />appealed to the Cabarrus County Planning and Zoning Commission serving as a Board of <br />Adjustment. Any appeal shall be reviewed by the Board under the standards used in granting a <br />variance (see Chapter 12). <br />Any request for relief of the literal provisions of this overlay zone shall also be reviewed under <br />the standards used in granting a variance. Prior to scheduling a hearing, a written request <br />detailing the proposed exception and a detailed site plan, as set forth in Chapter Twelve, shall <br />be sent to the Environmental Management Commission (EMC) for their review and <br />recommendation. If the EMC concludes that the variance, if granted, will result in a serious <br />threat to the water supply, then the item will not be heard or considered by the Board. If the <br />EMC recommends conditions or finds that the variance, if granted, would not result in a serious <br />threat to the water supply, then the item shall be scheduled and heard as a variance request by <br />the Cabarrus County Planning and Zoning Commission serving as a Board of Adjustment. <br />Any decision that overturns the Zoning Administrator shall be recorded and submitted to the <br />Supervisor of the Classification and Standards Group, Water Quality Section, Division of <br />Environmental Management on an annual basis. The record shall include the appropriate <br />section of the Board's adopted minutes of the meeting. <br />PART II WATERBODY BUFFER ZONE <br />Section 4 -8 Intention of Waterbody Buffer Zone <br />The purpose of the Waterbody Buffer Zone is to provide protected, vegetated strips of land <br />adjacent to streams, rivers, lakes, ponds, impoundments, or wetlands. These buffers are <br />retained in a natural, undisturbed, state, in an effort to avoid erosion problems and to reduce <br />the velocity of overland flow, thus trapping sediment and soil eroded from cropland or land <br />being developed to limit pollutants from entering the waterway. <br />Section 4 -9 Effect upon bona fide farms <br />Attachment number 2 \n <br />G -4 Page 341 <br />
