Memo <br />To: Cabarrus County Board of Commissioners <br />From: Susie Morris, AICP, CZO, Planning and Zoning Manager <br />CC: File <br />Date: 7/21/2015 <br />Re: Proposed Text Amendments to Zoning Ordinance (TEXT2015- 00002) <br />• Attached you will find several proposed amendments to the Cabarrus County Zoning <br />Ordinance. <br />• The Planning and Zoning Text Amendment Committee has been working with Staff and Legal <br />Counsel on general clarifications to various parts of the ordinance as well as changes that are <br />required due to SL2015 -86. <br />• The following is a list of the proposed changes: <br />o Chapter 3, Establishment of Zones. The Planned Unit Development (PUD) district is <br />being removed as an option. This district was tied to architectural standards for <br />residential development which in turn allowed higher densities. This is no longer <br />permitted due to SL2015 -86. <br />o Chapter 4, Overlay Districts and Zones. Changes to this chapter include clarification <br />to the Watershed language for consistency with State terminology, clarifications to the <br />Waterbody Overlay Zone regarding uses established prior to the adoption of the Zone <br />and the removal of the Recreation District Overlay which is no longer needed since <br />the uses listed are now addressed in the permitted use table and also have individual <br />performance standards. <br />o Chapter 5, District Development Standards. This chapter is being revised significantly <br />due to SL2015 -86 (SB25). This legislation prohibits the imposition of architectural <br />design standards for one and two family dwelling units. The Cabarrus County <br />Amenity Subdivision design option was based on a density bonus for incorporating <br />certain architectural design standards. All references to this design option and to <br />appearance standards for residential one and two family dwelling units are being <br />removed. Additionally, references to Appendix B are being updated to reflect the <br />proposed changes to Appendix B. <br />o Appendix B, Commercial Design Standards. When initially adopted, these standards <br />assumed that utilities were available to support a higher density, more intense type of <br />commercial development in unincorporated Cabarrus County areas. Since most of <br />the municipalities now require annexation for utility provision, the standards are being <br />revised to be more appropriate for the type of development that will more than likely <br />occur in unincorporated areas (individual buildings served by well and septic).
