V. Identification of Impediments to Fair Housing Choice <br />a. Public Sector <br />1. Zoning and Site Selection <br />Zoning <br />Are there any zoning requirements that have the effect of limiting housing <br />opportunities to protected groups? Cabarrus County and its towns and cities have a <br />wide range of residential zoning districts and product options. These options range from <br />zoning districts that have multifamily products to districts that include large lot <br />subdivisions, serving all citizens with housing choice. <br />Single family homes, multifamily, duplexes, triplexes, quadplexes and mobile homes are <br />allowed in multiple districts in most of the jurisdictions. There are 6 incorporated <br />municipalities in Cabarrus County. All six of these jurisdictions provide water and sewer <br />services permitting more dense development_ There are service agreements that limit the <br />extension of water and sewer lines into the unincorporated areas of the county, therefore, <br />dense development is impossible in much of the unincorporated areas. These limitations <br />were put in place several years ago in order to preserve agricultural land. <br />Some of the jurisdictions had some design standards in place such as architectural <br />guidelines, however, many of these regulations have been made illegal by recent <br />legislative action and are being removed from local ordinances. <br />2. Site Selection <br />Do current site selection policies have a disproportionate impact based upon a <br />protected basis? If so, is there a nondiscriminatory reason for this policy and is <br />there an alternative that would have a less discriminatory impact? Site selection for <br />the county entails site selection for housing grant programs. Staff does not believe that <br />there is a disproportionate impact for any protected class statuses. Homes are selected <br />based on windshield surveys, applications, and referrals from other agencies such as <br />DHS, other jurisdictions, and nonprofit agencies. All applicants are considered without <br />reference to race, color, creed, nationality, etc. All current housing repair and <br />rehabilitation programs are scattered site in nature. Some programs permit projects <br />throughout the county while others are only allowed in the unincorporated areas due to <br />funding regulations. <br />3. Are county services equitably distributed throughout the community? <br />Every effort is made to provide all County services on an equitable basis to all citizens in <br />the County. Staff feels that the distribution is as equitable as possible. Most of the <br />housing needs are met through a variety of housing services available in the County as <br />well as in the Cities. Any problems with equitable distribution may be attributed to the <br />client's qualification.
