Wake County Board of Commissioners <br />RESOLUTION SUPPORTING EWOLUNTAR'Y COMMTM ENT <br />TRANSPORT SERVICES WITH WAKEMED <br />WHEREAS, pursuant to NCGS § 122C- 251(a), the County has the duty to provide, <br />through its law enforcement officers, transportation under the involuntary commitment <br />proceedings of Article 5 of Chapter 1220 of the North Carolina General Statutes for (i) citizens <br />of Wake County, and (ii) any person taken into custody within Wake County limits <br />( "Transportation Services "); and <br />WHEREAS, WakeMed operates hospitals including emergency departments within <br />Wake County; and <br />WHEREAS, WakeMed hospitals and emergency departments receive mental health <br />patiTnts who are respondents in commitment proceedings pursuant to Article 5 of Chapter 1220 <br />of the North. Carolina General Statutes and who require Transportation Services from time to <br />time; and <br />WHEREAS, NCGS § 122C permits the Board of Commissioners to designate <br />private agency personnel to provide all or parts of the Transportation Services required by <br />involuntary commitment proceedings; provided such designated persons are trained and provided <br />the County's plan assures adequate safety and protection of both the public and the person <br />transported; and it fiuther appearing all requirements of section 251(g) are satisfied; and <br />WHEREAS, WakeMed was approved to contract with Lankford Protective Services, Inc., <br />an approved private provider of transportation services in 2011; and <br />WHEREAS, WakeMed desires to enter into agreements with additional or alternative <br />trained and certified private providers for provision of transportation services to and from <br />WakeMed Hospitals; and <br />WHEREAS, the agreements between WakeMed and private providers contracted to <br />provide transportation of involuntary commitment respondents will be consistent with the terms <br />of the Policy and Plan for Transportation of Wake County Involuntary Mental Commitment <br />Respondents as approved by the 'Wake County Board of Commissioners; that provider personnel <br />will receive Crisis Intervention Training; that providers will supply vehicles for the <br />transportation of respondents; that providers will provide liability insurance (general liability <br />coverage in the amount of $1 million per occurrence/$2 million in the aggregate per annum and <br />excess /umbrella coverage in the amount of $2 million per occurrence/$2 million in the <br />aggregate); that providers will comply with applicable law in the custody and transportation of <br />residents; and that providers agree to indemnify and hold harmless the County of Wake and the <br />Wake County Sheriff and his employees or agents; and <br />Attachment number 2 <br />F -2 Page 71 <br />
