V 1792 <br />U � <br />�n <br />RESOLUTION OF THE CABARRUS COUNTY BOARD OF <br />COMMISSIONERS ADOPTING A PLAN SUPPORTING PRIVATE PROVIDER <br />INVOLUNTARY COMMITMENT TRANSPORT SERVICES <br />WHEREAS, pursuant to N.C. Gen. Stat. §122C- 251(a), Cabarrus County has a duty to provide, <br />through its law enforcement officers, transportation under the involuntary commitment proceedings of <br />Article 5 of Chapter 122C of the North Carolina General Statutes; and <br />WHEREAS, N.C. Gen. Stat. §122C- 251(g) provides that the Board of Commissioners of the County <br />may adopt a plan for the transportation of respondents in involuntary commitment proceedings and <br />that private agency personnel may be designated to provide all or part of the transportation required by <br />such proceedings; and <br />WHEREAS, N.C. Gen. Stat. §122C- 251(g) further provides that persons designated in the plan to <br />provide transportation shall be trained and the plan shall assure adequate safety and protections for <br />both the public and the respondent; and <br />WHEREAS, the Cabarrus County Sheriff's Office, other local law enforcement officers and other <br />affected agencies participate jointly in execution of a plan for transportation of respondents in <br />involuntary commitment proceedings; and <br />WHEREAS, pursuant to N.C. Gen. Stat. §122C- 251(g), the Cabarrus County Sheriff's Office, local <br />law enforcement and other affected agencies are to provide adequate training in the transportation and <br />restraint of mental health patients to private agency personnel designated to provide transportation for <br />these respondents; and <br />WHEREAS, the Charlotte Mecklenburg Hospital Authority ( "CMHA ") operates hospitals, <br />including emergency departments, within Cabarrus County and surrounding counties; and <br />WHEREAS, CMHA receives mental health patients who are respondents in commitment <br />proceedings pursuant to Article 5 of Chapter 122C of the North Carolina General Statutes and who <br />require transportation services from time to time; and <br />WHEREAS, CMHA has entered into a contract with G4S Secured Solutions (USA), Inc. ( "G4S "), a <br />private agency, to provide all or part of the involuntary commitment transportation services between <br />CMHA facilities, and <br />WHEREAS, such an arrangement will assist the County and its Sheriff's Office in fulfilling their <br />obligations under Article 5 of Chapter 122C of the North Carolina General Statutes; <br />Attachment number 4 <br />F -2 Page 79 <br />
