of WSACC. Any user proposing to discharge any industrial waste to the POTW or who is now doing so must <br />make application to WSACC for a wastewater discharge permit. <br />(b) Any industrial user proposing to change the vohune or characteristics of an existing discharge shall request <br />from WSACC a determination as to whether or not a new application should be filed and shall provide <br />sufficient information on the proposed change to enable WSACC to determine the need for a new application. <br />If the proposed change requires a revision in a current SIU or local permit or requires a different type of permit <br />be issued, the user shall apply to WSACC for an appropriate wastewater discharge permit within 45 days of the <br />notification. <br />(c) When requested by the Executive Director, a user must submit information on the nature and characteristics of <br />its wastewater within thirty (30) days of the request, The Executive Director is authorized to prepare a form for <br />this purpose and may periodically require users to update this information. <br />(d) Any person discharging or proposing to discharge wastewater into the POTW shall be responsible at all times <br />for determining the volume and characteristics of its existing or proposed discharge. <br />4.2 Wastewater Diseli,nrge Permit Requirements <br />(a)(1) All persons meeting one or more of the requirements of an SIU of this ordinance shall obtain an industrial user <br />pretreatment permit prior to the commencement of construction or operations which will result in a discharge <br />to the POTW. Existing industrial users who are determined by the Executive Director to be SIUs shall obtain <br />an industrial user pretreatment permit within 180 days of receiving notification of the Executive Director's <br />determination. <br />For purposes of this definition, construction or operation has commenced if the owner or operator has: <br />(i) Begun, or caused to begin as part of a continuous on -site construction program: <br />(A) Any placement, assembly, or installation of facilities or equipment; or <br />(B) Significant site preparation work including clearing, excavation, or removal or existing <br />buildings, structures, or facilities which is necessary for the replacement, assembly, or <br />installation of new source facilities or equipment; or <br />(ii) Entered into a binding contractual obligation for the purchase of facilities or equipment which is <br />intended to be used in its operation within a reasonable time. Options to purchase or contracts which <br />can be terminated or modified without substantial obligation under this definition in accordance with <br />that Section with the provisions as stated in 40 CFR. 403.3.(x). <br />(2) Users who do not fit the SlU criteria may at the discretion of the Executive Director be required to obtain a <br />local pretreatment permit its necessary to carry out the purposes of this ordinance. <br />(3) Any violation of the terms and/or conditions of a wastewater discharge permit shall be deemed a violation of <br />this ordinance. Obtaining a wastewater discharge permit does not relieve a Permittee of the continuing <br />obligation to comply with all Federal and State pretreatment standards and/or requirements or with any other <br />requirements of Federal, State and local law. <br />(b) Significant Industrial User Determination <br />25 <br />Attachment number 5 <br />H -3 Page 280 <br />
