Cabarrus county Zoning Ordinance <br />Chapter 4- Overlay Districts and Zones <br />conditions or finds the variance, if granted, would not result in a serious threat <br />to the water supply, then the item shall be scheduled and heard as a variance <br />request by the Cabarrus County Planning and Zoning Commission serving as a Board <br />of Adjustment and Zening Appeals. <br />Any decision that overturns the Zoning Administrator shall be recorded and <br />submitted to the Supervisor of the Classification and Standards Group, Water Quality <br />Section, Division of Environmental Management on an annual basis. The record shall <br />include the appropriate section of the Board's adopted minutes of the meeting. <br />PART II WATERBODY BUFFER ZONE <br />Section 4 -8 Intention of Waterbody Buffer Zone <br />The purpose of the Waterbody Buffer Zone is to provide 5 `rotected, vegetated strips <br />4.9 -1- Impoundments for agricultural purposes <br />Impoundments used primarily for bona fide agricultural purposes, including animal <br />watering, irrigation, or other agricultural uses shall not be subject to buffering <br />requirements unless the waterbody is part of a natural drainage way (i.e., unless the <br />waterbody is located on a Class 1 or Class 2 stream); <br />Section 4 -10 Requirements of the Waterbody Buffer Zone <br />1. A minimum 50 -foot buffer shall be established on all sides of perennial or <br />Class 1 streams in addition to any lakes, ponds or impoundments. Class 1 <br />streams include all rivers, streams, lakes, ponds or waterbodies shown on the <br />USGS Quadrangle Maps as a solid blue line. <br />2. A minimum 30 foot stream buffer shall be established on all sides of all <br />intermittent or Class 2 streams and any identified wetlands. Class 2 Streams <br />shall include all rivers or streams shown on the USGS Maps as dotted or <br />Chapter 4 Page 4 of 34 <br />Revised 2013 <br />Attachment number 3 <br />G -1 Page 320 <br />
