Cabarrus County Zoning Ordinance <br />Chapter 4- Overlay Districts and Zones <br />For the remaining watershed area, the following requirements shall be met: <br />1. In all cases, the development of lots within the balance of the watershed shall <br />have an impermeable area of less than twelve percent (12 %). <br />A 50 feet vegetative buffer shall be n9aintained adjaeent te all perennima4 <br />st-rea„TT Waterbody buffers shall be established as required by the <br />Waterbody Buffer Zone section of this Ordinance. <br />Section 4 -6 Requirements for lands in the Lake Concord, Lake Fisher, and <br />Tuckertown Reservoir Watersheds <br />All land in the following watersheds of Lake Concord, Lake Fisher, and Tuckertown <br />Reservoir has been classified by the North Carolina Environmental Management <br />Commission as "Watersheds IV" drinking waters. The following requirements apply: <br />1. Unless prohibited by the underlying zoning district, densities are permitted up <br />to two (2) dwelling units per acre. 11�� <br />2. All non - single family residential and nonresidential development land shall be <br />permitted to build upon up to twenty -four (24 %) percent of the site. <br />Any existing development within the watershed area may be continued, as governed <br />by other sections of the Zoning Ordinance, and are subject to the following <br />provisions: <br />1. Vacant lots Platted but nondeveloped lots of record may be used even if <br />undersized, and to the extent possible, combined or reconfigured to create <br />one or more lots that meet the standards of the Ordinance. <br />Any request for relief of the literal provisions of this overlay zone shall also be <br />reviewed under the standards used in granting a variance. Prior to scheduling a <br />hearing, a written request detailing the proposed exception and a detailed site plan, <br />as set forth in Chapter Twelve, shall be sent to the Environmental Management <br />Commission (EMC) for their review and recommendation. If the EMC concludes that <br />the variance, if granted, will result in a serious threat to the water supply, then the <br />item will not be heard or considered by the Board.
