Cabarrus County Zoning Ordinance <br />Chapter 12- Administration and Enforcement <br />D. TIA Findings When the County and the applicant concur that the technical <br />analysis is complete, the report shall be forwarded to the <br />Commission. A subdivision improvement agreement detailing the applicant's <br />responsibilities and the County's responsibilities for implementing any mitigation <br />measures shall be prepared, and what, if any, improvements may be assessed <br />against other benefited properties. If the County finds that the proposed <br />development will not meet applicable service level standards, staff shall recommend <br />one or more of the following actions: <br />1. Reduce the size, scale, scope or density of the development to reduce traffic <br />generation; <br />2. Divide the project into phases and authorize only one phase at a time until <br />traffic capacity is adequate for the next phase of development; <br />3. Dedicate right -of -way for street improvements; <br />4. Construct new streets; <br />5. Expand the capacity of existing streets; <br />6. Redesign ingress and egress to the project to reduce traffic conflicts; <br />7. Alter the use and type of developmenf to reduce peak hour traffic; <br />8. Reduce background (existing) tr <br />9. Eliminate the potential for additional trg tion from undeveloped <br />properties in the vicinity of the proposed development; <br />10. Integrate non - vehicular design components (e.g., pedestrian and bicycle <br />paths or transit improvements) to reduce trip generation; or <br />11. Recommend denial of the application for development for which the TIA is <br />submitted. <br />E. Expiration of TIA. <br />1. Residential Pro' A T shall be valid for a period of two years from <br />the date of the preliminary plat approval by G abarrus County. <br />2. Commercial Projects. Where a preliminary plat is required for a <br />commercial project, the TIA shall be valid for a period of two years <br />from the date of the preliminary plat approval by the Planning and <br />Zening Commission. In the event a preliminary plat is not required for <br />the project and the project is subject to site plan review only, then the <br />TIA shall be valid for a period of two years from the date of site plan <br />approval by Cabarrus County Zoning Services. <br />3. Mixed Use Projects. The TIA for a mixed use project shall be valid for a <br />period of two years from the date of preliminary plat approval by <br />G abaFFHS County or site plan approval by Cabarrus County Zoning <br />Services, whichever occurs first. <br />Page 8 of 16 <br />Amended 2013 <br />Attachment number 5 <br />G -1 Page 391 <br />
